IMPHAL, January 9: A discussion on United Nations’ Law of Armed Conflict and Armed Forces (Special Powers) Act, 1958 was held today at Puangringlong village, Senapati.

The programme was jointly organised by the North East Dialogue Forum; People’s Action for Development NH-53, Senapati District; Puangringlong (Charoi Pandongba) Village’s Authority, Women Society, Youth Club and Farmers’ Club.

The consultation concluded by adopting several recommendations for both the government of India and the political armed opposition organisations.

The recommendations addressed to the government are immediate investigation into the cases of rape, torture, disappearances etc. committed by the government’s Security Forces in Manipur; urging the government to respect and implement the common article 3 of the Geneva Conventions, 1949 and Additional Protocol-II of 1977; urging the government to repeal AFSPA, 1958 and to provide compensation and assistance to the victims of rape, torture, trafficking and families of those civilians killed by the Indian Security Forces.

While, the recommendations addressed to the political armed opposition groups are to respect and implement the common article 3 of the Geneva Conventions, 1949 and Additional Protocol-II of 1977; to reconcile and stop factional fights in the interest of the civilians and to sign and respect the Deed of Agreement of Geneva Call.

Sobita Mangsatabam speaking on the topic, “Justice Verma Committee’s report and Rape as an Instrument of War” stated that United Nations Security Council Resolution 1820 of June 19, 2008 defined rape as an instrument of war.

She further said that Verma Committee’s Report also reflected the same observation and recommended for trial of rape cases in the civil court even while AFSPA is in use. Citing some incidents of rapes as examples including cases of Th Manorama (Bamonkampu), Ningthoujam (o) Ahanjaobi (Takyenthongbal), Rose (Ngaprum Khullen Ukhrul) and Operation Bluebird by the Indian military, she said that rape and other sexual violence had been used as an instrument of war by different actors in the ongoing armed conflict.

She called upon all the likeminded civil organizations and individuals to come together and build a collective struggle to end the heinous crimes committed against women.

Giving the key note address, P Ashen president, PAD-53, stated that the people of Manipur and other north eastern states have been reeling under violent armed conflict for the last more than 5 decades.

Extra-judicial execution, torture, enforced disappearances, rape, illegal detention, committed against the indigenous Manipuris people with intention to destroy, a national or ethnic or racial or religious group in the pretext of counter insurgency is nothing but genocide said Ashen.

He also described AFSPA as “dated and colonial-era law that breach contemporary international human rights standards.”

Speaking as a resource person, U Nobokishore secretary United NGOs Mission-Manipu, said that the International Humanitarian Law or simply Law of War is a set of rules which seek, for humanitarian reasons, to limit the effects of armed conflict. He added that International Humanitarian Law classifies armed conflicts as international armed conflict (IAC) or non-international armed conflict (NIAC).

He said that Common Article 3 of the Geneva Conventions of 1949 specifically applies in the case of conflicts “not of an international character”. Common Article 3, stipulates the minimum protection that must be afforded to all those who are not, or who are no longer, taking an active part in hostilities

Like common Article 3, Additional Protocol II provides the humane and non-discriminatory treatment of all those who are not, or who are no longer, taking part in hostilities. Most of provisions of Protocol II are now considered as a part of customary IHL and, thus, binding on all parties to NIACs added Nobokishore.

IMPHAL, January 9: The dead body of an unidentified woman was found from near Lily Hotel at North AOC, Wednesday evening around 5 pm by a team of Imphal Police Station.

Police said the woman could be somewhere around 32 to 37 years old, with a height of about 5’2’’, long hair, fair complexion and elongated face.

The woman is of thin built, wearing blue coloured salwar kamish and red colour jersey.

A police source said that the decreased woman might be aged between 32 to 37 years old, about 5’2’’ high height with long hair, fair complexion, elongated face. Her body is thin built, wearing a blue color salwar kamist and red color jersey.

The body has been deposited at the RIMS morgue for identification.

The police source also said that the body will be disposed-off after taking permission from the concerned District magistrate, if it remains unclaimed till January 11.

IMPHAL, January 9: The Ukhrul District Saw Mills Owner Association has submitted an application to the chief secretary of Manipur requesting him to protect the legal saw mills and at the same to control illegal saw mills in Ukhrul district under factory Act, 1948 (regulation of Saw Mills and Supreme Court Order W.P. (C) 202/1995).

According to application, it is state that the state government is not implementing Factory Act. 1948 (Regulation Saw Mills) and agendas of XI meeting to review Supreme Court Order passed in W.P. (C) 20211995 held under the chairmanship of the chief secretary, Manipur dated June 16, 2012 and hence, there is no regulation or protection of running legal licence Saw Mills and control of illegal Saw Mills running in respect of Ukhrul District, it said.

The release further said that there are more than 30 Saw Mills running within Ukhrul district and out of these, only three Saw Mills are possessing legal licence i.e. Zimik Saw Mills at Hamleikhong, Hundung, Phazang Saw Mill at Dungrei, Hundung and Mingthing Saw Mill at Shangshak.

The office of the Divisional Forest Officer, Eastern Forest Division, Manipur has issued order to inspection of Saw Mills running in Ukhrul District, memo No. 1711/ WBI2010-11IEFD dated 18/07/2012. However, instead of controlling, the numbers of illegal Saw Mills are at increasing.

Due to increasing number of illegal Saw Mills, the legal Saw Mills Owner running in the district could not compete with the former in production at market, as they are free from any taxes, duties etc. Further, they have installed the machine in forest from one place to other, adding that illegal felling or supply of timber is happening due to increasing illegal Saw Mills, it said.

The prevalence of Hepatitis C among individuals in Manipur engaged in injecting drugs is more than 90 percent according to official reports. Gross negligence has been cited as one of the results for the high infection rate of Hepatitis C among IDUs and the death rate from this condition in the state has been rising due to co-infection with HIV. Organizations dedicated to eradication of HIV/AIDS have been instrumental in arresting the spread of HIV, but people with Hep C have suffered due to the absence of such dedicated organizations, sufficient awareness campaigns, absence of free diagnostic facilities and unaffordable rates of drugs. In a way, Hepatitis C has taken the form of a hidden epidemic. Due to persistent negligence and lack of prevention and treatment efforts from the Union health ministry and concerned departments, the path has been cleared for a faster devastation due to Hep C.

The cost of treatment is very expensive standing around Rs 7-6 lakh, although in selected places it has been lowered to around Rs four lakhs without testing charges and Rs 5 lakhs for full treatment. In any case this is an amount that many people will find very hard to bear. Many organisations in Manipur have raised the need for government intervention in arranging cost-effective treatment and preventive measures for Hep C patients asserting that its prevention will have a positive impact on stopping the spread of HIV as well. There has not been any encouraging response from the administration though and many lives have been lost in the period due to the inability to get proper medical care.

Another factor that has apparently hit the people infected with the disease is the lack of proper treatment guidelines and preventive measures to control its onslaught. Even though, Hep C has been regarded as more dangerous than HIV as the virus causing it can last in open atmosphere for much longer period and the chances of transmission are very high, it has been perennially neglected by the authorities when it comes to recognition as a health risk. People infected and affected by Hep C have complained that there are no specific programmes or help groups working for their welfare. Moreover, the dissemination of information regarding the disease and medical experts specializing on its treatment programme are very few, particularly in the state. Patients have confided that they have hesitation in taking the medication prescribed by the doctors as they suspect whether the method of treatment will be capable of saving their lives. Showing more seriousness in countering the threatening disease, the state and Central governments should respond positively for reimbursement to patients with Hep C cases. The pharmaceutical companies should not take advantage of the prevailing conditions by hiking the price of the drugs on their free will. Moreover, the administration should consider the recommendations of the pro-Hep C groups on incorporation of Hep C awareness and treatment in national HIV and blood-borne disease prevention programmes, inclusion of hepatitis C in the state policy for HIV/AIDS and hepatitis medicines in the national essential medicines list and integrate hepatitis C surveillance in the existing HIV sentinel surveillance.
