Shri H. Rishikesh Sharma, District Programme Manager, National Rural Health Mission, Thoubal district, said that one of the most important flagship programmes launched by the Government of India is the National Rural Health Mission(NRHM).
Shri Rishikesh Sharma was speaking as a resource person during the morning session of the three-day Bharat Nirman Campaign which began today at the Mini Secretariat Hall, DC Complex, Thoubal in Manipur.
He said, though the NRHM was launched in 2005 elsewhere in the country, it was first implemented in Manipur only in 2006. Yet the programme is fully implemented in every nook and corner of Manipur.
Shri Rishikesh Sharma said, the health of a nation can be measured through the health of the mothers and infants. When the Maternal Mortality Rate(MMR) and Infant Mortality Rate(IMR) can be reduced considerably, the health of a nation can be said to be improved significantly. It is really remarkable that the MMR used to account for 375, nearly 400 in one lakh delivery in Manipur in 2005 before the NRHM was officially launched in the state. But today it has been brought down to 120. The IMR in Manipur used to be quite high in 2005, but today it has been reduced to 12. The target is below 10.Expressing serious concern over the ever increasing population in the minority community in Manipur, especially in Thoubal district , the resource person said that there are a number of families in the district where the family members easily claimed that the number of members in the family is ONLY 12. Besides there are areas starting from 100 meters on either side from the National Highway that passes through Thoubal town, where many consider the age of 13 of a girl as too late for marriage. It is very common that a girl is married off at the age of 15 in these areas in Thoubal district. In such scenario, the NRHM, Thoubal is making all out efforts to spread awareness among the people the health hazards that may come from getting married early.The resource person also highlighted the various benefits provided under Janani Suraksha Yojana(JSY) and Janani Suraksha Karikrama (JSK). He appealed to the women, especially the expectant mothers to choose the hospitals for delivery as the hospitals are the safest place for child delivery.An interaction programme was also held between the audience and the resource person.

Double Decker coaches were first introduced on Indian Railways in 1975 mainly aimed at providing higher carrying capacity in short distance commuter trains. The intended objective of Indian Railways was achieved but these Non-Air Conditioned coaches could not become very popular among commuters. The main reason was that they had to face lot of dust ingress from the low level windows of the lower deck and the view outside was also not very pleasant at the platform level height. With these concerns, proliferations of Non-AC double deckers on Indian Railways was not pursued further.
With past experience at hand, Indian Railways once again conceived double deckers but this time in Air Conditioned configuration that could address the problems faced in Non-AC variants and the first announcement for introduction of AC Double Deckers was made by the Minister of Railways in the Rail Budget 2009.
Considering the existing fixed structures like Road-over-bridges, Foot-over-bridges, electrical traction equipment etc. across the entire length and breadth of Railways, it was a real challenge to design a double decker coach without raising the overall height. This challenge was further compounded by the fact that air-conditioning equipment and air-ducts are also to be provided within the same envelope.
Taking it as a mission, a team of design engineers of Indian Railways started the development process of putting more coach per coach and that too, totally in-house. Their ingenuity was proved when Rail Coach Factory, Kapurthala a production unit of Indian Railways, was ready with the first prototype AC Double Decker in a record time of only nine months. After all mandatory tests in the field, the first AC double decker train was introduced on Indian Railways between Howrah and Dhanbad in October 2011.
Now further, an improved design of such train has been developed and its services between Jaipur and Delhi and Ahmedabad and Mumbai have been introduced. Such services are also planned between Habibganj-Indore and Chennai-Bangalore in near future. AC double decker train with improved passenger friendly design is having capacity of 120 passengers per coach compared to 78 passengers in Shatabdi Chair cars thus increasing the capacity by more than 50 per cent. The AC double decker train, with low fares, has brought the comfort of AC travel within the bounds of many wannabe passengers and is becoming popular among passengers.
The new air-conditioned coaches have many technical features like light weight stainless steel body with aesthetically pleasing interiors. Eurofima design bogies with air springs provide superior ride quality. For safety of the passengers, couplers with anti-climbing features and shells with crashworthy structure have been introduced. This design was substantially lower tare weight per passenger, thus making them highly energy efficient.
The overall height of these coaches is only marginally higher (4.5 inches) because the space for two decks has been managed by optimally using the well area between the two wheeled bogies. Latest design software was used in the development process and it was extensively validated through virtual prototyping before taking up actual manufacturing.
The successful development of AC Double Decker Coach is a clear illustration of Indian Railways’ prowess in development of technology and its resolve to meet the expectations of an aspiring nation.

IMPHAL, Jan 29 NNN : Sadar Hills Chiefs Association (SAHILCA) seriously deliberated on the ‘new developments’ vis-a-vis guidelines on the MGNREGS.
An executive body members of the SAHILCA on Tuesday in a meeting minutely discussed the new developments being initiated by the state government regarding the implementation process of MGNREGS in Manipur. The house also took serious note of the order/guidelines issued by the state government for involvement of the Autonomous District Councils (ADCs) and other line departments in the implementation system of MGNREGS.
As per the order/guidelines issued by the state Government, 25% MGNREGS funds have been given to the ADCs and another 25% to other line departments.
The order/guidelines of the state Government is in total contravention of the MGNREGS guidelines issued by the central Government. It may be noted that a state Government cannot change or alter the guidelines issued by a Union Ministry.
“Therefore, in view of the stated facts and circumstances, the executive meeting of SAHILCA took the resolutions that the state government should cancel its order immediately.
The MGNREGS guidelines issued by the Central Government should be followed as it is without any alteration, SAHILCA added. Another resolution said the state government should compensate the job card holders for delaying the payment till date in accordance with the MGNREGS guidelines.
“If these resolutions/demands are not fulfilled within February 3 the chiefs of Sadar Hills shall be compelled to launch intense agitations from the flowing days, for which the state government shall be held responsible for any untoward incidents,” one resolution of SAHILCA said.
Earlier, welcoming the gathering Premlata Loitam MCO, PIB Imphal said Bharat Nirman campaign had been held in different parts of the country covering the entire stretch of the state and the one being organized at Thoubal today is the thirteenth of such programmes. She spoke at length about the various schemes implemented by the Government of India to extend benefits to the common masses. The campaign is launched to make common masses aware of the various schemes that include mid day meal, ICDS, MGNREGA, RTI, IAY, PMGSY rural telephony etc. She appealed to all to make themselves aware by listening to the speeches made by expert speakers at the three day campaign.

IMPHAL, Jan 29 NNN: Seven children from Meghalaya who were rescued by Manipur police from human traffickers in Thoubal district of Manipur have been handed over to their families by the state Social Welfare Department on Tuesday.
The five boys and two girls are among the 12 minors age between 6 and 13. They were handed over to their parents during a simple function held at the premises of the state Social Welfare department.
They were handed over to the families for repatriation after WK Blah, chairperson, Child Welfare Committee, Meghalaya and the Child Welfare Committee, Thoubal signed an agreement during the function.
The children were rescued by Thoubal police at a police check-post from a private vehicle in which they were travelling. The vehicle was heading for Moreh in the Chandel district of Manipur. Then, the police had handed them over to Child Welfare Committee, Thoubal.

KOHIMA, Jan 29 (NEPS): Much anticipated Mega “2nd IFMA-WMC Imphal National Muaythai Challenger Cup 2013 and 2nd Imphal IFMA National Muaythai Convention 2013” is coming to enthrall the sports and martial arts lovers of Manipur with the opening of these Mega Muaythai Events on February 1, 2013 at Khuman Lampak Sports Complex, Imphal, Manipur.

Around 300 participants including 100 officials from across the country are expected to take part in this “2nd IFMA-WMC Imphal National Muaythai Challenger Cup 2013 and 2nd Imphal IFMA National Muaythai Convention 2013” from February 1 to 4, 2013.

The “IFMA-WMC Imphal National Muaythai Challenger Cup and Imphal IFMA National Muaythai Convention” is an annual permanent project of Muaythai Federation of India (MFI) for the State of Manipur in which all the 28-MFI affiliated units from across the country are invited to take part. The “Event” is organized by MFI Pro-Muaythai Promotional Council under the aegis of International Federation of Muaythai Amateur, IFMA, world headquarters, Bangkok, Thailand and MFI.

There will be 14 weight categories for Senior Male, Junior Male, Senior Female and Junior Female and Sub-Junior Divisions.

During this “2nd IFMA-WMC Imphal National Muaythai Challenger Cup 2013 and 2nd Imphal IFMA National Muaythai Convention 2013,” there will also be several “Muaythai Programs” like Seminars and Camps. During this time, MFI leaders who have been sacrificing for the “promotion and development” of Muaythai in the country will be awarded “Highest Honor.” “Awardees” of this “Highest Honor” will be screened by the MFI Award Screening Committee.

Now too many projects have been covered by the scheme.
In Thoubal District two projects have been opened one at Thoubal and another at Kakching. Under Thoubal scheme 765 anganwadi centres have been opened and 459 under Kakching scheme. The aim and object of the scheme are to take care of children below six years of age and pregnant women.
She said nutritious foods are provided to the children at the centre to enable them grow up properly with a view to ensure that they get education at the right time. Immunisation programme is also conducted by ICDS through the anganwadi centres. Pregnant women are also given proper education on child delivery. Anganwadi workers carry out the programmes envisaged under the scheme. Supplementary nutritious foods are distributed through the anganwandi workers. Anganwadi workers are also given training to give proper education to the children to enable them lead a normal life.
She said, if there is cooperation between the villagers and the implementing agencies all these programmes will be successful. No programme howsoever beautiful it may be will not be successful unless there is proper cooperation from the masses.
Replying to queries from the gathering she said, there are supervisors in the district who strictly supervise the functioning of the anganwadi centres in the district. She urged the villagers to write in detail what the centres are doing and they are not doing so that proper action can be taken against them, she added. We have pulled up some of the workers and questions had been put to them why they were not doing their duties properly. Milk and cooked foods are distributed to the centres, she added replying to another question put by a young boy.
Another boy wanted to know the criteria adopted in the selection of anganwadi workers. She informed that one must own land and be a 10 plus 2 passed candidate. But rules were flouted in the selection of anganwadi workers and even those, who did not own land were selected so when we asked them to construct a shed for the children we were ridiculed, she said and added that the Government do not earmark fund for construction of shed for the young children. Questions also were put at the end of the session by the expert speaker to the crowd and the winners were given prizes.

The Ministry of Minority Affairs was created on 29th January 2006 to ensure a focused approach towards issues relating to the minorities and to facilitate the formulation of overall policy, planning, coordination, evaluation and review of the regulatory framework and development programmes for the benefit of the minority communities. The Ministry aims for inclusive development of minorities notified under National Commission for Minorities Act, 1992, viz. Muslims, Christians, Sikhs, Buddhists and Parsis. The Ministry adopted a multi-pronged strategy for development of minority communities with focus on:
Ø educational empowerment;
Ø area development;
Ø economic empowerment; and
Ø strengthening of minority institutions.
The Ministry has made intensive efforts for educational empowerment through Pre-matric, Post-matric, Merit-cum-means based scholarships and Maulana Azad National Fellowships. Online Scholarship Management System (OSMS) has been developed and launched for the on-line applications under Merit-cum-means Scholarship scheme. Now it has also been extended to Post-Matric Scholarship scheme as well. During 11th Plan, these schemes have been a great success and Rs.2672 Crore have been disbursed to more than 1 Crore 40 Lakh students belonging to minority communities including more than 30% eligible minority girls. During current financial year of 12th Plan period (till December 2012), Rs. 826.03 Crore have been released to support education of more than 50 lakh minority students under Scholarship programmes. The Ministry has also taken action on Direct Benefit Transfer (DBT) under Merit cum Means Based Scholarship Scheme. To strengthen the efforts towards educational empowerment, the corpus of Maulana Azad Education Foundation (MAEF), an autonomous body under the Ministry, has been raised from Rs.100 crore to Rs.750 crore to award scholarships to meritorious minority girls. We endeavour to raise the corpus further to Rs.1500 Crore to expand coverage of minority students. MAEF has also increased the number of meritorious girl students to 25,000 for award of Maulana Azad National Scholarship.
Under Area Development strategy, the Ministry has two major programmes viz. Prime Minister’s New 15 Point Programme and Multi-sectoral Development Programme (MsDP). In order to intensify the Government’s efforts and bring in synergy with the programmes of other Ministries/Departments, Prime Minister’s New 15 Point Programme for minorities was launched in June 2006. This overarching programme envisages specific interventions with definite goals to be achieved in a specific time frame. The programme aims for enhancing opportunities for education, ensuring an equitable share in economic activities and employment, improving living conditions through infrastructure development for minorities, and prevention and control of communal disharmony.
Through Prime Minister’s 15 Point Programme, the Central Government ensures equitable allocation of resources for development of minorities by earmarking 15% of target/outlays under important flagship development programmes of Government – Integrated Child Development Services, Sarva Shiksha Abhiyan, Swarna Jayanti Gram Swarojgar Yojana, Indira Awas Yojana, Swarnajayanti Shahari Rozgar Yojana, Upgradation of ITIs into Centres of Excellence, Priority Sector Lending through Banks etc. Further, special initiatives have also been taken for providing quality education in Madarsas and infrastructure development of Minority institutions under the scheme of Department of School Education and Literacy, and for recruitment of minorities by Department of Personnel and Training.
MsDP is the flagship programme of the Ministry. The programme aims at improving the socio economic conditions and basic amenities for improving the quality of life and reducing imbalances in rural and semi rural areas of 90 identified Minority Concentration Districts (MCDs). Under this programme, identified “Development deficits” are addressed through a “District Specific Plan” for provision of better infrastructure for education, sanitation, housing, drinking water and electricity supply besides income generating activities. These district specific plans are formulated by the respective State/UT Departments dealing with minority welfare and in this way provide ample opportunities for innovation and participation from Panchayati Raj Institutions and local bodies. Three tier monitoring mechanism of MsDP with involvement of People’s Representatives makes this programme more focussed.
During 11th Five Year Plan, Rs. 2963 Crore were released by the Ministry under MsDP to 20 States/Union Territories (UTs) to create infrastructure. The States which performed well under MsDP include Maharashtra, Karnataka, Meghalaya, Kerala, Jammu & Kashmir, Madhya Pradesh and Odisha. During current year of 12th Plan period (till December, 2012), Rs. 503.23 Crore have been released to various States/ UTs under MsDP for construction of 4719 houses under Indira Awas Yojana, 142 Health Centres, 1790 Anganwadi Centres, Installation of 15161 hand pumps, 918 additional classrooms, 26 School buildings, 12 Polytechnics, 39 ITI buildings and 102 Hostels for minorities. Under Prime Minister’s 15 Point Programme, Rs. 171960.71 Crore have been extended under Priority Sector Lending through banks to minorities and 269770 houses under Indira Awas Yojana have been sanctioned. In addition, the percentage of recruitment of minorities in Central Government Ministries/Departments has reached the level of 15%.
During 12th Five Year Plan, expansion of Prime Minister’s New 15 Point Programme is high on agenda. Restructuring of MsDP is being done for sharper focus on minority concentration areas, and extending the benefit of this programme to blocks and cluster of villages.
In order to enhance economic development of minorities, the National Minorities Development & Finance Corporation (NMDFC) provides concessional loans to minorities through its State Channelising Agencies (SCAs). The SCAs identify the beneficiaries, channelize the lending and also make recoveries from the beneficiaries. In the 11th Five Year Plan Period, a total amount of Rs. 977.21 Crore was disbursed to 467909 beneficiaries under Term Loans and Micro Finance to the minorities who are double below the poverty line. During 2012-13, till December, 2012, a sum of Rs. 185.25 Crore has been disbursed to 50737 beneficiaries. The Ministry also provides financial support to SCAs through grant in aid scheme for development of their infrastructure and delivery system. To expand the coverage of minorities under the schemes of NMDFC and strengthen the delivery mechanism, NMDFC is in the process of restructuring.
From the year 2012-13, the Ministry has started implementation of an ambitious scheme for “Leadership Development of Minority Women” with objective to empower and instill confidence among minority women including their neighbours from other communities living in the same village/locality, by providing knowledge, tools and techniques for interacting with Government systems, Banks and other institutions at all levels. The outlay for financial year 2012-13 is Rs.15 Crore. The physical target under the scheme during 2012-13 includes providing training to 40,000 (forty thousand) women belonging to notified minority communities with a mix of women from non- minority communities not exceeding 25% of the project proposal. The trainings are organized through Non-Governmental Organizations on modules viz. Leadership, Government Systems, Diseases among Children and Prevention, Public Distribution System, Schemes/Programmes for Minorities, Life Skills, Health and Hygiene, Nutrition, Home Management, Family Planning, Issues related to women and Waste Water Sanitation & Solid Waste Disposal. So far, Rs.10.45 Crore have been released to 64 organizations of 12 States for implementation of the programme for 36950 women during current financial year.
The Ministry is making all efforts to implement the recommendations of Sachar Committee. The decisions taken by the Government on the recommendations of the Sachar Committee have been grouped
in various categories for the sake of convenience viz. measures for affirmative action, education, skill development, access to credit, special development initiatives, Wakfs and miscellaneous. Ministry has taken up action for implementation of these recommendations by involving all stakeholders including other relevant Ministries/Departments. In addition, the Ministry takes periodical review meetings in order to monitor the progress of implementation of the decisions of the Government.
The Ministry has also initiated constitution of Equal Opportunity Commission (EOC). The objective of EOC is to ensure equal access to opportunity, entitlements/ rights to deprived groups belonging to minority communities. The EOC would help to secure equitable development of policy and implementation of programmes in public administration and private enterprise.
An Assessment and Monitoring Authority (AMA), under the aegis of the Planning Commission, has also been constituted to evaluate the extent of development benefits which accrue to different Socio-Religious Communities through various development programmes of the Government.
A “National Data Bank” has been created to maintain disaggregated data for various socio-religious communities which is to be collected by the Ministry of Statistics and Programme Implementation to enable the evaluation and assessment of flow of benefits to minorities on a regular basis.
To improve the management of Wakf properties and streamline the functioning of State Wakf Boards, the Wakf Amendment Bill 2010 was passed in the Lok Sabha in May, 2010. The Bill was then referred to a Select Committee of the Rajya Sabha where Report was tabled on 16.12.2011. The Bill is under final stages of formulation and will be sought to be put up for consideration and passing of the Rajya Sabha in the Budget Session 2013-14.
The Ministry has also launched the scheme for “Computerization of records of State Wakf Boards” in 2009, and introduced a web-enabled portal software called Wakf Management System of India (WAMSI) to develop centralized database for all State Wakf Boards covering areas such as, registration of Wakfs, Litigation tracking, Mutawalli return assessments, leasing details of properties and a document management system. 25 States/UTs have set up their Centralized Computing Facilities and have taken up the computerization of Wakf properties. As on date, a total of 1,82,233 Wakf properties have been registered. Further, the work of digitization of the Wakf records has also started in most of the Wakf boards. In addition, the Ministry is contemplating to formulate a new scheme for Skill Development of Minorities. The Ministry intends to intervene to help workers engaged in growth-oriented sectors to become part of the larger network of market oriented firms engaged in that sector. For those caught in the stagnant sectors, a transition path is required to be evolved. Skill up-gradation, education and credit availability, will have an important role in both these strategies. The Ministry understands that for inclusive growth of the minorities, among other interventions it is also important to make them aware about the Government’s welfare programmes. For intensive awareness generation, Ministry draws an annual Media Plan with the help of DAVP, All India Radio, Doordarshan, NFDC etc. at the beginning of each financial year for multi-media campaign. In addition, the audio-visual publicity is also done through Private FM Channels, Digital Cinema, Exhibition vans, LCD screens at public places etc. Simultaneously, Ministry has taken initiatives to monitor the outcomes and quality of implementation of Government programmes for minorities through independent agencies. Social Audit and concurrent monitoring of Area Development schemes/programmes has also been envisaged during 12th Plan. We are aware that our friends from minority communities deserve more attention. However, we hope that our humble efforts will certainly bring visible change in the standards of living and upliftment of the minorities. (PIB Feature).

Kukis’ agitation on the national highway has been suspended after the agitationists were locked in dialogue with the Chief Minister O. Ibobi Singh yesterday. They heard the appeal made by the Chief Minister to suspend the agitation considering the hardship it has caused to the people of the state. Demands can be made. That’s the democratic right of the people living in India. But one must weigh the practicability aspect of the demand. We have built castle in the air in the dream. Dream is different. You can do anything you can fly like superman. But in real life it happens nothing much can be done and we have to accept the reality of life where we are and where we are born. We must not attempt to bring heaven on earth. We cannot compare our state with Singapore. The strategic location of a state should be considered. Tiny state like Goa and Pondicherry in the south can survive on their own without taking much help from the Union Government. Their economy shaped by income from tourism is thriving. Development must take place. But not at the cost of the interest of the state. The state interest will never be sacrificed. Chief Minister has rightly said that he will oppose anything that is detrimental to the well being of the state. Recently when he met the top leaders of the Union Government he took a stand that is quite convincing. He exists to serve the state and he will even sacrifice the post he is holding in the event of Union Government taking a decision to bifurcate the state to appease a section of the people. Similar stand that he took will be reflected as and when situation calls. Therefore protagonists of the homeland are advised not to indulge in wild dreaming. We are citizens ofManipur. Let us think of contributing something to the growth of the state. Let us ask our representatives not to waste time without doing anything. Our representatives can be asked to supervise the developmental programmes launched in different constituencies for early completion and also for maintaining quality. It happens construction programmes launched at the hills and remote villages are not properly supervised so they crumble even before inauguration. At the end the Government is blamed for all that is done at the remote areas. To save the Government from landing in embarrassing situation a mechanism needs to be evolved to see to it that the construction programmes launched at the remote areas are properly supervised. Having talked to the Chief Minister the leaders of the Kuki state demand committee might have realised what needs to be done and what should not be done. Nevertheless the leaders of the committee are to be appreciated for taking a stand that will go long way in nurturing the relation among different communities living in the state. Better sense prevails.

Thoubal, Jan 29: Three day Bharat Nirman campaign began today at the Mini Secretariat hall of Thoubal DC complex. The inaugural function was graced by E. Manglemjao Up-Adhakshya as chief guest, Kh. Amuba Singh as guest of honour and Deputy Commissioner of Thoubal District T. Ranjit Singh IAS as functional president. S. Inaugurating the function E. Manglemjao observed that Bharat Nirman campaign launched in the district will make large number of people in the district aware of the various schemes and programmes of the Government of India. The campaign will help in nurturing the relation between the Government departments and the common masses.
Kh. Amuba ZEO Thoubal spoke about SSA and said this is an important flagship programme. He said proper coordination, cooperation and sincerity on the part of implementing agencies will make Government programmes a success.
In his presidential speech T. Ranjit Singh IAS said various schemes and programmes have been framed and extended in Thoubal district. Government programmes are taken up in a phased manner. He said the campaign will play a big role in making common masses aware of the benefits extended by the Government of India to the people of Manipur. He narrated how Mahatama Gandhi National Rural Guarantee scheme became an act and added that the act has empowered the beneficiaries to get the benefits under the act. He said MGNREGA funds are not released at one go. But subsequent funds will not be released if there is any complaint from the beneficiaries. The subsequent funds will be released only when the complaints are disposed off. He appealed to the elected representatives of the local bodies to read the provisions contained in the various schemes of the scheme so that they will be able to help the common masses in getting benefits from the Government.
He also said the district authority has also been doing a lot of work to make the common masses aware of the benefits they can under the various schemes of the Government of India. He expressed the hope that the campaign will achieve the target of reaching out to the masses. He appealed to all those present at the inaugural function to remain alert and put queries to the expert speakers who will be speaking on different topics to extract information as to how they can get benefits from the government.
He said RTI implemented by the Government of India has cautioned Government officials to carry out their duties honestly and sincerely. He appealed to all to use RTI judiciously for the betterment of the society.

IMPHAL, Jan 29:  120 trucks loaded with petroleum products which had earlier been stranded at Khatakhati in Assam following  the total public blockade called by the Kuki State Demand Commitee (KSDC) in Kuki inhabited areas from 5 p.m. of 24 January  arrived safely today at around 10.30 p.m. at Imphal. A source said the tankers included 99 diesel tankers and 21 LPG bullet tankers. The source further informed that the oil tankers which arrived today and which have parked at the inter state bus terminus (ISTB)had been escorted by CRPF personnel as usual. The petroleum tankers to be escorted by CRPF personnel would leave for Khatkhati, Imphal after unloading at IOC depot and. On the other hand, 15 oil tankers among the empty ones escorted by Manipur Rifles personnel which left Imphal along the Imphal-Jiribam road reached Ram Nagar, Silchar yesterday itself and would return to Imphal after the loading. It may be mentioned that the blockade has been suspended following an agreement between the government and the KSDC representatives.

IMPHAL, Jan 29: The Manipur Mountaineering & Trekking Association (MMTA) deeply mourns the demise of late Thanjaliu wife of M Taithoungam, chief of the Lamdan village and also a patron member of MMTA, on January 27, said a release of the association.

“The MMTA has lost a great guardian with her untimely demise who contributed in the growth of the Manipur Mountaineering Institute Complex Lamdan,” it said.

The joint meeting of MMTA held on January 29 observed a two minute silence and prayed for the departed soul and shared the grief of the bereaved family, it added.

The Indian woman is still unfree, exploited, sold as commodity, liquidated without the law and held hostage by an exploitative combination. Gender injustice meted to the weaker sex is a disturbing concern of all Indians, men and women, politicians, professionals and people with a social conscience, and we must battle for the cause of Freedom and Development of  the feminine sector as an integral and strategic part of the struggle for human justice. No society can be free, fair or just until its women enjoy freedom and justice and opportunity for unfoldment of their full potential.

The Constitutional imperatives of equality of status and opportunity, Social justice, dignity and personality for the Indian woman remain mere paper rhetoric and fatuously futuristic. So long as the raw realities of life contradict with bleeding wounds and burnt flesh, daily humiliation on the road, inside the bus, public places etc. and legal discrimination, the fighting creed is writ into the Founding Deed. Life is the touch stone of law, and not printed articles in Paramount charter. The myth is that equality of the sexes is guaranteed by the state. The truth is that inequality and indignity vis a vis  the reality faced by women are writ so large as to mar the veracity of Fundamental Rights. Despite laying down of the Guide Lines by the Supreme Court to prevent sexual Harassment of women at work place, the belief of the judiciary has not been fully achieved. The Vishaka judgement, (Vishaka & others V. State of Rajasthan, (1997)6 SCC 241; AIR 1997 S.C. 3011) came on 13.8.1997. Yet, 15 years after the guidelines were laid down by the Supreme Court  for the prevention and redressal of Sexual harassment and their due compliance under Article 141 of the constitution of India until such time appropriate legislation was enacted by the Parliament, many women still struggle to have their most basic rights protected at workplaces. The statutory Law is not in place as the protection of women Against sexual Harassment at Work Place Bill, 2010 is still pending in Parliament though Lok Sabha is said to have passed that Bill in the first week of September, 2012. The belief of the Constitution Framers in fairness and justice for women is yet to be fully achieved at the workplace in the country.

In the Medha Katwal Lele V. Union of India, A.I.R. 2013 S.C. 93 a bench of three judges of the Supreme Court held at Page 101 Para 15 that “As a largest democracy in the world, we have to combat violence against women. We are of the considered view that the existing laws, if necessary, be revised and appropriate new laws be enacted by Parliament and the State Legislatures to protect women from any form of indecency indignity and disrespect at all places (in their homes as well as outside), prevent all forms of violence-domestic violence, Sexual assault, Sexual harassment at the workplace, etc. – and provide new initiatives for education and advancement of women and girls in all spheres of life. After all, they have limitless potential. Lip service, hollow statements and inert and inadequate laws with sloppy enforcement are not enough for true and genuine upliftment of our half most precious population – the women.”

The Supreme Court in the case (Supra) at Page-101 Para 16 held the “view that guidelines in Vishaka should not remain symbolic and the following further directions are necessary until legislative enactment on the subject is in place.” It said:

i ) The States and Union Territories which have not yet carried out adequate and appropriate amendments in their respective Civil Services Conduct Rules (By whatever name these Rules are called) shall do so within two months from to-day by providing that the report of the Complaints Committee shall be deemed to be an inquiry report in a disciplinary action under such Civil Service Conduct Rules. In other words, the disciplinary authority shall treat the report / findings etc. of the Complaints Committee as the findings in a disciplinary inquiry against the delinquent employee and shall act on such report accordingly. The findings and report of the Complaints Committee shall not be treated as a mere preliminary investigation or inquiry leading to a disciplinary action but shall be treated as a finding / report in an inquiry into the misconduct of the delinquent.

ii) The states and Union Territories which have not carried out amendments in the Industrial Employment (standing orders) Rules shall now carry out amendments on the same lines as noted above in clause (i) within two months.

iii) The States and Union Territories shall form adequate number of Complaints Committee so as to ensure that they function at Taluka level, District level and State level. Those States and/or Union Territories which have formed only one Committee for the entire State shall now formed adequate number of Complaints Committees within two months from to-day. Each of such complaints Committees shall be headed by a woman and as far as possible in such committees and independent member shall be associated.

iv) The State functionaries and private and public sector undertakings/ organisations/bodies/institutions etc. shall put in place sufficient mechanism to ensure full implementation of the Vishaka Guidelines and further provide that if the alleged harasser is found guilty, the complainant – victim is not forced to work with/under such harasser and where appropriate and possible the alleged harasser should be transferred. Further provision should be made that harassment and intimidation of witnesses and the complainants shall be met with severe disciplinary action.

v) The Bar Council of India shall ensure that all bar associations in the country and persons registered with the State Bar Councils follow the Vishaka Guidelines. Similarly, Medical Council of India, Council of Architectures Institute of Charterred Accountants, Institute of Company Secretaries and other Statutory Institutes shall ensure that the organisations, bodies, associations, institutions and persons registered/affiliated with them follow the guidelines laid down by Vishaka. To achieve this, necessary instructions/circulars shall be issued by all the statutory bodies such as Bar Council of India, Medical Council of India, Council of architecture, Institute of Company Secretaries within two months from today. On receipt of any complaint of sexual harassment at any of the places referred to above the same shall be dealt with by statutory bodies in accordance with the Vishaka Guidelines and the guidelines in the present order.

The Supreme Court in the case (Supra) at Para 17 held: “We are of the view that if there is any non-compliance or non-adherence to the Vishaka guidelines, orders of this court following Vishaka and above directions, it will be open to the aggrieved persons to approach the respective High Courts. The High Court of such State would be in better position to effectively consider the grievances raised in that regard. 

VISHAKA GUIDELINES

In Vishaka and others v. State of Rajasthan, (1997)6 SCC 241 a bench of 3 Judges has laid down the following guidelines and norms at Page 252 Para 17 as:

Having regard to the definition of “human rights” in Section 2(d) of the Protection of Human Rights Act, 1993, taking note of the fact that the present civil and penal laws in India do not adequately provide for specific protection from sexual harassment in work places and that enactment of such legislation will take considerable time, it is necessary and expedient for employers in work places as well as other responsible persons or institutions to observe certain guidelines to ensure the prevention of Sexual harassment of women.

– It shall be the duty of the employer or other responsible persons in workplaces or other institutions to prevent or deter the commission of acts of sexual harassment and to provide the procedures for the resolutions settlement or prosecution of acts of sexual harassment by taking all steps required.

DEFINITION: For this purpose, sexual harassment includes such unwelcome sexually determined behaviour (whether directly or by implication) as: physical contact and advances; a demand or request for sexual favours; sexually – coloured remarks; showing pornography; any other unwelcome physical, verbal or non-verbal conduct of sexual nature.

Where any of these acts is committed in circumstances whereunder the victim of such conduct has a reasonable apprehension that in relation to be victim’s employment or work whether she is drawing salary, or honorarium or voluntary, whether in government, public or private enterprise such conduct can be humiliating and may constitute a health and safety problem. It is discriminatory for instance when the woman has reasonable grounds to believe that her objection would disadvantage her in connection with her employment or work including recruiting or promotion or when it creates a hostile work  environment. Adverse conduct in question may be visited if the victim does not consent to the conduct in question or raises any objection thereto.

PREVENTIVE STEPS

All employers or persons in charge of workplace whether in the public or private sector should take appropriate steps to prevent sexual harassment without prejudice to the generality of this obligation they should take the following steps:

– Express prohibition of sexual harassment as defined above at the work place should be notified, published and circulated in appropriate ways.

– The rules/regulations of government and public sector bodies relating to conduct and discipline should include rules/regulations prohibiting sexual harassment and provide for appropriate penalties in such rules against the offender.

– As regards private employers steps should be taken to include the aforesaid prohibitions in the standing orders under the Industrial Employment (Standing Orders)Act, 1946.

– Appropriate work conditions should be provided in respect of work, leisure, health and hygiene to further ensure that there is no hostile environment towards women at work places and no woman employee should have reasonable grounds to believe that she is disadvantaged in connection with her employment.

CRIMINAL PROCEEDINGS:

Where such conduct amounts to specific offence under the Indian Penal Code or under any other law, the employer shall initiate appropriate action in accordance with law by making a complaint with the appropriate authority. In particular, it should ensure that victims or witnesses are not victimised or discriminated against while dealing with complaints of sexual harassment. The victims of sexual harassment should have the option to seek transfer of the perpetrator or their own transfer.

DISCIPLINARY ACTION:

Where such conduct amounts to misconduct in employment as defined by the relevant service rules, appropriate disciplinary action should be initiated by the employer in accordance with those rules.

COMPLAINT MECHANISM:

Whether or not such conduct constitutes an offence under law or a breach of the service rules, an appropriate complaint mechanism should be created in the employer’s organisation for redress of the complaint made by the victim. Such complaint mechanism should ensure time-bound treatment of complaints.

COMPLAINTS COMMITTEE:

The complaint mechanism, referred to in(6) above, should be adequate to provide, where necessary, a complaints committee, a special counsellor or other support service, including the maintenance of confidentiality.

The complaints committee should be headed by a woman and not less than half of its members should be women. Further, to prevent the possibility of an undue pressure or influence from senior levels, such complaints committee should involve a third party either NGO or other body who is familiar with the issue of sexual harassment. The complaints committee must make an annual report to the Government Department Concerned of the complaints and action taken by them.

The employers and person-in-charge will also report on the compliance with the aforesaid guidelines including on the reports of the complaints committee to the Government Department.

WORKERS’ INITIATIVE:

Employees should be allowed to raise issue of sexual harassment at workers’ meeting and in other appropriate forum and it should be affirmatively discussed in employer-employee meetings. Awareness of the rights of female employees in this regard should be created in particular to prominently notifying the guidelines (and appropriate legislation when enacted on the subject) in a suitable manner. Where sexual harassment occurs as a result of an act or omission by any third party or outsider, the employer and the person-in-charge will take all steps necessary and reasonable to assist the affected person in terms of support and preventive action. The Central/State Governments are  to consider adopting suitable measures including legislation to ensure that the guidelines laid down by this order are also observed by the employers in private sector.

AMENDMENT IN CENTRAL CIVIL SERVICES (CONDUCT) RULES, 1964

Following the directives of the Apex Court, the Central Government has amended the Central Civil Services (Conduct) Rules, 1964 and inserted the following provisions as Rule 3-C.

3-C. PROHIBITION OF SEXUAL HARASSMENT OF WORKING WOMEN.

– No Government servant shall indulge in any act of sexual harassment of any woman at her workplace.

– Every Government servant who is in-charge of a work place shall take appropriate steps to prevent sexual harassment to any woman at such work place.

Explanation:- For the purpose of this rule, “Sexual harassment” includes such unwelcome sexually determined behaviour, whether directly or otherwise, as – Physical contact and advance; Demand or request for sexual favours; Sexually coloured remarks;Showing any pornography or any other unwelcome physical, verbal or non-verbal conduct of a sexual nature.

Complying with the directives of the Supreme Court, the Central Government has amended the Central Civil Service (Classification, Control and Appeal) Rules, 1965 and has inserted the following proviso to Rule 14(2):

“Provided that where there is a complaint of sexual harassment within the meaning of Rule 3-C of the Central Civil Service (Conduct) Rules, 1964, the complaints Committee established in each Ministry or Department or Office for inquiring into such complaints, shall be deemed to be the Inquiring Authority appointed by the Disciplinary Authority for the purpose of these rules and the complaints Committee shall hold, if separate procedure has not been prescribed for the complaints committee for holding the  inquiry into the complaints of sexual harassment, the inquiry as far as practicable in accordance with the procedure laid down in these rules.

Explanation – where the Disciplinary Authority itself holds the inquiry, any reference in sub-rule(9) to sub-rule(20) and sub-rule(22) to the Inquiry Authority shall be construed as a reference to the Disciplinary Authority. It has been expressly mentioned in Rule 3 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 that there rules shall apply to every Government servant including every civilian Government servant in the Defence services, but shall not apply to :- any Railway servant, as defined in Rule 102 of Volume-1 of the Indian Railways Establishment Code, any member of the All India Services, any person in casual employment, any person subject to discharge from service on less than one month’s notice, any person for whom special provision is made, in respect of matters covered by these rules, by or under any law for the time being in force or by or under any agreement entered into by or with the previous approval of the President before or after the commencement of these rules, in regard to matters covered by such special provisions.

In Mewa Ram Ramcharan V. United Provinces, A.I.R. 1954 Allahabad 487, the Allahabad High Court held that the procedure provided in Civil Services (classification, control and Appeal) Rules would not therefore, apply to the departmental trials under Section 7 of the Police Act and they will be governed by the Police Act or by any regulations framed under the Police Act.  Again, the Delhi High Court in a case as reported in Rajeshwar Singh V. Union of India, (1989)11 ATLT 621(HC) held that employees governed by CISF Rules, 1969  can not be charge  sheeted under the Central Civil Services (Classification Control and Appeal) Rules.

The legal position as discussed above makes it abundantly clear that subordinate ranks of police force from the rank of constable up to the Inspector are to be governed by Section 7 of the Police Act, 1861 and Rules  framed there under for dealing with departmentally. Similar amendment as inserted in the Central Civil Services (Classification, Control and Appeal) Rules, proviso to Rule 14, is also required to be inserted in the Police Rules at Police Manuals not only for preventing Sexual harassment of women at the work place in compliance with the directives of the Supreme Court of India so that Disciplinary Authority can act on the reports of the complaints committee but also for uniformly implementing the directives of the Supreme Court.

CONCLUSION:

Brave new India must make every woman free spiritually, socially, economically, culturally, politically so that the issue of sexual harassment is erased from the society once for all. Such is the imperative of our independence; such is the commitment to the constitution. Freedom is indivisible as between man and woman. Either both or neither. Then only can woman power break its promethean chains and emerge unbound through law.

The wonders of research and advancements in science and technology, never ceases to amaze but the news of an impending series of animal studies to test what could end up being the world’s first “vaccine” against alcoholism to get ‘problem drinkers’ to quit on their own raises various layers to a health and social issue. The announcement from the Centre for Biochemical Engineering and Biotechnology at the University of Chile has said pre-clinical studies of the candidate vaccine developed there, would be conducted in India beginning next month. The studies are to be taken up by a clinical research agency in Navi Mumbai specializing in toxicological studies on rodents. Typically, all pre-clinical studies involve administering mice or rats, the new drug or vaccine to determine whether it has any harmful side effects and always precede human trials of any product. If the tests on the rodents turns out well, the next logical step would be to look at human trails. While there is no solid news regarding where the human trails will be conducted, it is to be noted that the Supreme Court has directed that no new clinical trials will be approved in India for at least two months, till the time the health ministry defines a regulatory regime for such tests in the country. The Supreme Court directives had come in response to a public interest litigation filed by activist group in February 2012. In October last year, the apex court had asked the health ministry to make public information regarding deaths during trials, the compensation being paid and other general practices related to the conducting of such trials.

India’s track record with clinical human trails is dismal. In fact, the Drugs Controller General of India (DCGI) said in a 3 January filing to the Supreme Court that between January 2005 and June 2012, it approved 475 clinical trials for “new chemical entities” not used as drugs elsewhere in the world. The figures it quoted were alarming. It said that 11,972 adverse effects, excluding deaths, were reported in the period, with 506 of these being directly attributable to the trials and put deaths from trials at 2,242 over the last five years. What is implied in the figures is that a lot of these numbers and statistics had happened because people participating in the human trails were ill informed about the risks involved, were paid poorly and were not being regulated properly. There are alarm bells over the ethical norms of clinical trails being flouted with news emerging that children and the disabled were encouraged to take part in such trails without their full and informed knowledge or permission.

But while the courts and regulating bodies debate and discuss on the area, what is interesting is that a vaccine against alcoholism may well be within sight in a matter of a few years time. When such a vaccine against alcoholic tendencies does become a reality, it may root out the impact of chronic alcohol use on the human body. But it is yet unclear if such a vaccine will also address issues of people who resort to verbal abuse, uncouth behavior and even physical violence while under the influence of alcohol. Alcohol abuse as we know not only encompasses health but touches upon human and social behavior, not to mention gender stereotypes. The other good news that such a vaccine would herald would be for those in the liquor business for they can well continue selling the poison drink with the confidence that people vaccinated against it would be spared of its ill effects. There may be a futuristic scene sometime in the years ahead where, along with vaccines for DPT, Hep B etc children are also vaccinated with the anti alcoholic shot!

Many in the State would be happy if a medical miracle brings about a one shot treatment of people who have become alcoholics as well, considering that there are not too many options available for treating someone who is already a chronic alcoholic. If indeed such a thing becomes a reality, many social organizations who have taken upon the role of moral guardians may have to begin looking for other issues to tackle.

IMPHAL, January 29: The All Manipur Students’ Union, AMSU has said in a press release that under its initiative of transforming the education system, it has been spreading awareness amongst the parents and guardians of school students on the fee structure of private schools.

The press release while pointing out the increase in admission and monthly fees of several schools and the charging of high computer fees, has said that certain private schools in the state have been charging fees according to their wish without any consideration for the students and their parents and guardians.

It has said that there are certain schools whose computer fees is more than the monthly fees of other schools, even though there is a question on how beneficial  such classes are to the students.

There is also the question of how many computer classes do these schools provide to the students in a week, it said.

The AMSU has charged in its press release that there are certain schools which have started to charge computer fees only for commercial purposes. The press release has further identified certain schools which are charging exorbitant computer fees above the monthly fees. It has further said that there are also institutions which have computer classes but do not charge extra computer fees.

There are schools which charge library fees from even students of pre-nursery, nursery and KG classes, which means that these schools have become a means of earning, it said.

Whereas the Section 5 (b) of the Board of Secondary Education, Manipur clearly states, “The aim of the management should be to impart quality education to the children and not to earn any profit” and the Right to Education Act, Section 18 and Manipur Government RTE Rule 2010 rule 11 (b) Recognition of School says, “The school is not run for profit to any individual, group or association of individuals or any other persons”, the release said.

Several schools located in the urban area have been ignoring all such rules and have been charging fees according to their wishes, it said.

“There are also schools that charge establishment fees, registration fees, development fees and maintenance fees during admission of a student into the school and schools which charge laboratory Development fees which show that the schools had been opened only for commercial purpose,”

The release said and urged the government and its concerned department to look into the issue at the earliest. It has further urged the government that in case it cannot develop the government schools in the state, then the government should provide scholarship, teacher’s grant, incentives, etc.

It has also urged the schools under the Catholic Educational Society not to increase their admission fees and monthly fees and to submit a list of the teachers’ salaries to the student body.
