New Delhi, Aug 29 : The Special Judge, CBI, cases Guwahati has convicted Jagjibon Chakraborty, the then Tax Assistant, Income Tax Office, Dimapur (Nagaland) & Keishing James (Private person) of Chingmeirong, Tangkhul Avenue, Imphal (Manipur) and sentenced them to undergo two years Rigorous Imprisonment with fine of Rs. 20,000/- each in a cheating case.
CBI had registered a case on 30/03/1990 and filed a Chargesheet on 31/12/1992 against Jagjibon Chakraborty, the then Tax Assistant, Income Tax Office, Dimapur (Nagaland) and Keishing James (Private person) U/s 120B, 420, 467, 468, 471 of IPC and Section 13(2) r/w 13(1)(d) of P.C.Act 1988 in the Court of Special Judge, Dimapur (Nagaland), which was later transferred to the Court of Special Judge, Guwahati (Assam). It was alleged that the accused persons had made fraudulent withdrawals of Income Tax Refunds amounting to Rs.5,32,987/-(approx) on the basis of fake/forged Income Tax Deduction at Source (TDS) Certificates in the name of fictitious assessees and thereby cheated the Government of India.
The Trial Court found both the accused guilty and convicted them.
