Probe finds AFSPA useless in fighting insurgency

IMPHAL, July 16 NNN: The report of Supreme Court appointed ‘Commission on Extrajudicial Execution’ in Manipur that is now with the CSCHR member Extrajudicial Execution Victims’ Families Association, Manipur (EEVFAM), has made various recommendations like police commandos cannot be allowed to ‘terrorize people at will’ as they appear to be doing presently.
The report says there is no doubt that insurgency in Manipur state is a reality, but the continuous use of Armed Forces (Special Powers) Act, 1958 for decades in the state has evidently had ‘little or no effect’ on the situation.
On the other hand, the six cases of extrajudicial killings, which have shown to be not real encounters, are egregious examples of the AFSPA’s gross abuse, it says.
Babaloo Loitongbam, executive director, Human Rights Alert (HRA) informed that the report of Supreme Court appointed Commission on Extrajudicial Execution in Manipur is now with EEVFAM. He said this during a media briefing at the HRA office here on Tuesday.
Citing the report, Babloo said the Jeevan Reddy Committee to review the AFSPA after its own hearings found that this Act had become “a symbol of oppression, an object of hate and an instrument of discrimination and high-handedness.”
The report recommends that the Manipur administration has to be made more sensitive, proactive and responsive and that the police and policing have to be made more people-friendly.
He further cited the report recommending police commandos cannot be allowed to terrorize people at will as they appear to be doing presently.
The state level police complaint authorities should also have at least one member from the civil society and must review the functioning of the District Level Police Complaint
Authority on a quarterly basis, Babaloo mentioned the report as saying.
It is clear to the Commission that Manipur state police on its own is grossly inadequate to face the challenges before it, the report says and adds that therefore it is strongly
recommended that the Manipur Government draw up and implement a five-year plan for strengthening and training of the civil police in the state so as to altogether do away with the deployment of Union armed forces in aid of the civil power.
Babaloo also said EEVFAM will win justice as the six cases are in continuous progress and informed that the next hearing on the cases will be held in the apex court on August 6.
Representatives of EEVFAM are ready to present at the hearing in New Delhi, he added. The last hearing on the cases was held at Hotel Classic, Imphal from March 3-7 last year.
He also appealed to all who want to add their views and opinion to the recommendations to get in touch with HRA and EEVFAM.
EEVFAM president Renu Takhellambam and family members of the victims were also present at the briefing.
The Supreme Court appointed Commission is headed by the former Lokayukta and retired Supreme Court Justice N Santosh Hegde, which includes the former Chief Election Commissioner, J.M. Lyngdoh, and the former DGP, Karnataka, Ajay Kumar Singh.
The apex court appointed the special high-powered commission of inquiry on January 4, 2013 to investigate the six cases from a list of 1528 cases submitted by EEVFAM.

CBI officials to go to jail

MNS The Special Judge for CBI Cases, Saket Courts, New Delhi has convicted Murari Lal, then SP, CBI and sentenced him to undergo four years Simple Imprisonment with total fine of Rs.5 Lakh 20 thousand in a bribery case.
A case was registered by CBI on 12.08.1999 U/s 120 B IPC r/w sec 7, 8 & 9 of Prevention of Corruption Act, against Murari Lal, the then SP, CBI; then Dy. S.P. and others on
the allegation that the accused persons were acting as middlemen between suspects / accused persons of some cases under investigation in CBI and the concerned Investigating
Officers/ Law Officers, with a criminal conspiracy to subvert investigation of such cases by influencing the IO / Law Officers in favour of the accused persons. In the process, the accused had allegedly accepted huge amounts as illegal gratification for such IOs/ Legal Officers and for themselves.
After thorough investigation, CBI filed a charge sheet against Murari Lal, the then SP, CBI and the then Dy. S.P, U/s 120 B IPC r/w sec 8 & 9 of Prevention of Corruption Act, 1988. The then Dy SP died during trial and the proceedings against him were abated.
The Trial Court found the accused guilty and convicted him.

For many parents, family members and loved ones of people killed in the country under what are being called ‘fake encounters’ whose claims that the ones who died were innocent have been ignored and rather portrayed as false, the announcement of ‘fake encounters’ from legal agencies and by investigating systems are but just the beginning of long struggles to justice. The families of seven men in the prime of their life who were killed by state and central armed forces have only begun the difficult journey to see that those involved in the killings gets their just due. And while the seven families do have the consolation knowing that their loved ones were indeed caught in the trap of encounter killings, there are over thousands of others who are still to be heard. When, the Extrajudicial Execution Victims’ Families Association, Manipur (EEVFAM), a body made of family members of those killed by various state and central security forces as encounters, referring to a situation of armed firing filed a PIL to the Supreme Court listing 1528 cases of fake encounters, referring to staged versions of encounters and seeking for the setting up of a Special Investigation Team (SIT) and direct inquiry into all cases, the Apex Court had announced a three member Commission led by Justice Hegde. During the course of the inquiry Commission’s sittings in Imphal and then New Delhi, the loopholes in the versions of the ‘encounters’ given by security personnel came in glaring spotlight, not to mention the liberties that were taken in the process of investigations and police inquiry. Since the Army personnel involved in the 6 cases were examined in New Delhi on the grounds that many were posted in different parts of the country, not many in the state would be aware of the nuances that emerged in the narratives of events with literally ‘trigger points’ being pointed to the state police personnel who are not protected under AFSPA. The Commission after examination of witnesses and hearing out depositions said all six cases in which seven people were killed were indeed fake encounters and have now listed its recommendations to the Apex Court on ways and means to see that justice is served and the state police are reined in. Not surprisingly, the Commission’s report has also pointed out that the imposition of AFSPA and the impunity that it gives to the Armed forces are an important crux in the nature of encounter killings taking place in Manipur.

Earlier Social Welfare Minister AK Mirabai has said that pending honorariums and salary for the Anganwadi workers and Helper for three months to the respective CDPOs.

IMPHAL, July 16: A powerful hand grenade hurled by unidentified miscreants exploded today inside the Regional Institute of Medical Sciences (RIMS), Lamphelpat campus around 2.30 pm.

According to report, the bomb hurled by unidentified persons fell at a security barrack situated near the Officer’s Colony inside the RIMS campus. However, there was no report of any casualty in the attack.

A case has been registered at the Lamphel Police Station in connection with the incident, it added.

Meanwhile, a Chinese hand grenade was found at Langol View Clinic closed to the RIMS campus, Lamphelpat this morning around 8.30am.

Later, a team of bomb disposal squad of Lamphel Police retrieved the bomb.

In another incident, a powerful Improvised Explosive Device (IED) was found just near the back side of Herbert School located at Changangei under Lamphel Police Station in Imphal West District at around 10.15 today morning.

Later, a bomb expert team of Lamphel Police Station diffused and retrieved the bomb.

It is said that the IED was planted inside a Tin fish can.
