Serial rape accused fails to appear to court summon

LAMKA, July 10: Rape accused Timothy Changsan who is charged under Protection of Children from Sexual Offences Act of serial raping girls many of whom are orphans in a children home where he was the director, failed to appear before the District and Session Court, Churachandpur today.

The Manipur High Court had recently revoked his bail a few days ago after he was found to be out on bail under mysterious condition last month.

The police have been on the look-out for the accused even to the extent of raiding his potential hide-outs.

However, the brother of the accused was seen loitering around the court complex today and even submitted a petition that his brother is in Imphal and can`™t appear before the court in Churachandpur as he was in Imphal as curfew is imposed in the State capital at the moment.

It is also learnt that the IO of the case, SI Sandy Tonsing had himself delivered the court summon personally long before the imposition of the curfew.

At the same time, the Judge who had issued the summons also failed to turn up due to the curfew raising many eyebrows.

Several sections of the society including the Manipur Alliance and Child Rights- Churachandpur and Action for Women and Child Advancement are convinced about the manner the accused was released on bail.

It is also interesting to note that the accused had hold a press conference announcing legal notice to the MACR-CCpur who champion the cause and the print media of the district through his lawyer advocate MI Sharma.

It may be recalled that Timothy Changsan is charged of raping seven girls while he was the administrator of NECH after the seven girls escaped from the boarding home and complaint to the police.

Any accused under the POCSO Act, which carry a minimum sentence of 10 years imprisonment, in no circumstances, is allowed to be granted bail for six months, however, it this case, the accused was granted bail only after 92 days.

MLA Ibohalbi grills dy CM over death of student

IMPHAL, July 10: Deputy Chief Minister Gaikhangam who also holds the portfolio of Home failed to response to a series of queries raised by opposition MLA Dr I Ibohalbi Singh

IMPHAL, July 10: Deputy Chief Minister Gaikhangam who also holds the portfolio of Home failed to response to a series of queries raised by opposition MLA Dr I Ibohalbi Singh on the death of a student of Ananda Singh Higher Secondary Academy while staging a protest demanding ILPS implementation in the state, during the last sitting of the 11th Session of the 10th Manipur Legislative Assembly today.

The opposition MLA raised his queries while putting up last business of the House on `consideration and passing of the Manipur Appropriation Bill, 2015`™.

The MLA suspected that a Magistrate would have been present at the site where the student was killed in police action and demanded the identity the Magistrate if he happened to be present at the time when the unfortunate took place.

He also demanded the Dy CM the identity of the police officer who commanded the retaliation against the student agitators, claiming that he knows the identity of the police officer.

The MLA then referred to a telecast aired by a TV news channel wherein an IPS Probationary Officer fired shots from his service revolver towards a group of agitators who were protesting the death of the student in police action at Khurai yesterday.

The agitators were just 30/40 foot away from the IPS Probationary Officer, he claimed.

The IPS officer could have achieved his purpose by blank fires alone so why did he fire shots deliberately towards the agitators, the MLA asked, demanding the Dy CM to reveal the identity of the police officer.

Taking part in the heated discussion, MLA Th Shyamkumar Singh pointed out that police personnel were seen entering into kitchen and buildings of agitators who were demanding implementation of Inner Line Permit System in the state and beating them as shown in the local cable networks.

He urged the government to look into the excesses of the police personnel whose duty is to control mob not to beat them.

When Works Minister Dr Kh Ratankumar Singh was responding to the motion, raised by three opposition MLAs including L Ibomcha Singh, Chief Minister O Ibobi Singh suddenly stood up and said that the bill is related with finance so he is the one who should response to the motion.

Though the CM came to the rescue after the opposition MLAs raised the Khurai incident, Dy CM remained silent on the issue.

House adjourns for 10 mins after uproar over ILPS issue

IMPHAL, July 9: Speaker of Manipur Legislative Assembly Th Lokeshwar Singh had to adjourn the House for 10 minutes during its ongoing 11th Session today after one of the ruling

IMPHAL, July 9: Speaker of Manipur Legislative Assembly Th Lokeshwar Singh had to adjourn the House for 10 minutes during its ongoing 11th Session today after one of the ruling MLAs named an opposition MLA repeatedly over the death of a student during a protest staged yesterday demanding withdrawal of Manipur Regulation of Visitors, Tenants and Migrant Workers Bill, 2015 and its replacement by another stronger bill.

Opposition MLAs Dr I Ibohalbi Singh and Th Shyamkumar Singh moved a calling attention motion in the House while discussing the ongoing agitation launched by Joint Committee on Inner Line Permit System (JCILPS), withdrawal of Manipur Regulation of Visitors, Tenants and Migrant Workers Bill, 2015 and implementation of Inner Line Permit System in the state.

The calling attention motion was raised by the two MLAs on `to call the attention of Deputy Chief Minister on the death of a student in the tussle between the student agitators and police personnel and subsequent imposition of curfew`™.

Along with admitting the motion by the House, the Speaker gave approval for discussion on motion raised by the MLAs.

While the two MLAs were deliberating on the motion, MLA N Biren from the side of the ruling government intervened and appealed to the Speaker to make the motion as `short duration discussion`™ stating that the death of the student is a serious issue concerning the state.

Following his intervention, the Speaker converted the motion into `short duration discussion`™ after taking consent of the House Members.

Taking part in the discussion, MLA Dr I Ibohalbi Singh reiterated that the House had adopted three resolutions regarding ILPS implementation in the state.

He pointed out that the bill passed by the House does not include the six points recommended by the All Political Party Committee on ILP.

As such, the bill should be withdrawn taking into account of the wishes of the people. The public are in tension following the death of the student. It will be a wise step to convene a special session in the House to discuss the matter, he said.

MLA Th Shyamkumar said that he had pleaded the House to put the bill under a Select Committee of the House before it get passed but the bill was passed without thorough discussion.

Appealing the House to enact a fresh bill in place of the earlier one, he said that police personnel lack training when it comes to controlling student agitators.

He also said that curfew is the solution to diffuse outcry of the public over the demand for ILPS implementation in the state.

MLA L Ibomcha contended that the bill was framed by three Officers whom he does not want to name in the House.

He said that the present public outrage over the ILPS implementation should not be taken lightly by the House.

MLA N Biren while mourning the death of the student appealed for an enquiry into the incident.

During the discussion held under Rule No 71 of Rule of procedure and Conduct of Business, MLA Ng Bijoy referred to the statements made by MLA Th Shyamkumar during a press conference held yesterday, which was published in some local dailies.

MLA Bijoy by holding Xerox copies of the statements made by the MLA in his hands, which was published in four local dailies repeatedly named the MLA in the House.

Immediately MLA Shyamkumar himself, Dr I ibohalbi Singh and Samuel Rison intervened and appealed to the House to stop the comment of MLA Bijoy.

They claimed that there was nothing wrong in the statement made by MLA Shyamkumar, which was published in local dailies.

As the Speaker refused to accept their plea, the three opposition MLAs began shouting in condemnation of the comment made by MLA Biren, creating brawl in the House.

Following the chaotic situation, the Speaker adjourned the House for ten minutes.

Ruling MLA RK Anand, Dr Kh Ratankumar, Y Irabot Singh and K Meghachandra Singh also took part in the heated discussion.

Manipur Police comes under heavy criticism for student`s death

IMPHAL, July 9: A day after police action to control a student rally in the State capital resulted in the death of a student of the Ananda Singh Higher Secondary

IMPHAL, July 9: A day after police action to control a student rally in the State capital resulted in the death of a student of the Ananda Singh Higher Secondary School, the Manipur Police has come under heavy criticism from all sections of the society.

The Manipur Commission for Protection of Child Rights has resolved to take up a Suo moto case on the incident of firing by the Manipur police which led to the death of Sapam Robinhood, a class XI student of Ananda Singh Higher Secondary School.

A press release of the MCPCR said the commissioner express serious condemnation of the unfortunate incident of firing by the Manipur Police which led to the demise of the student.

It said the police firing leading to death and injury of students is a clear cut case of violation of child rights, especially their right to life and dignified survival, as guaranteed by the Constitution of India and the UN Convention on Rights of the Child.

The decision to take up the suo moto case was arrived at during an emergency meeting held at its official premises, according to the press release.

It continued, the commission has also written to the director general of police to furnish details of the incident, the particulars of the personnel involved in the firing.

It has also sought details of any action taken including filing of criminal cases against those police personnel involved in the firing and has also informed the National Commission on the Protection of Child Rights of the firing incident for necessary action.

Meanwhile, in a separate statement, the North-East Forum for International Solidarity (NEFIS) said it condemns the `brutal killing of a student while protesting against the government in Manipur.`

According to the statement, hundreds of NEFIS activists gathered and gheraoed the Manipur Bhawan in New Delhi in protest against the police action and demanded an immediate and independent inquiry into the incident.

NEFIS also met the Resident Commissioner of Manipur and submitted a memorandum addressed to the Chief Minister of Manipur demanding immediate suspension of the police personnel responsible for the death of the student.

It said today a large number of students from different regions of North-East, led by NEFIS protested against the high-handed crackdown of police on peaceful protesters in Manipur.

The police brutality on people was once again demonstrated on Wednesday, when a student was killed while demonstrating against the Government, it said.

The class XI student was fatally wounded when to scatter the protesters, a tear gas shell fired from close range hit him, it said.

It should be noted that the people who were protesting were innocent school students of different educational institutions, the NEFIS said.

It is shameful that police could not tolerate even a peaceful protest by students and shockingly tried to disperse the protesters using reprehensible means, it continued.

NEFIS has also demanded an immediate stop on any mode of repression on peaceful Democratic movements and said it will take the issue to national level, if the demands are not immediately heard.

The Apunba Manipur Kanba Ima Lup, AMKIL has also condemned the police action.

A statement of the organisation said the use of brute force by the police to control the students is condemnable and the government should punish the involved personnel at the earliest.

A statement of the organisation said it also shares the grievances of the family of the dead student.

It has also said that EECHAL will support the movement of JCILPS.

The Pangal Students`™ Organisation has also condemned the incident and criticized the government action of using brute force to contain the movement demanding safeguard of the indigenous people.

It has further demanded that in case the government is unable to properly govern the State, they should step down on moral grounds.

If in a democracy, democratic form of agitation is stopped using force, the very meaning of democracy is defeated, it said.

The PSO has also demanded termination of all personnel involved in the incident.

The All Manipur Gorkha Students`™ Union have also strongly condemned the killing of the student and injuring dozens others in police action and demanded the government to punish the involved police personnel.

The Bill was extensively recommended following a detailed discussion for more than five months, the Chief Minister who is also the leader of the House observed.

There may have been some recommendations of the All Political party Committee on ILPS which were nor incorporated in the Bill and with the recommendations of the Joint Committee on Inner Line Permit System, he continued.

This was in apprehension of whether the Governor would give his assent or not, Ibobi said before continuing that however, a few days before the start of the present Assembly session, the Bill failed to receive the assent of the Governor and has been kept as `Bill is reserved for consideration of President.`

He further suggest to discuss whether at this stage the Bill can be withdrawn by the House and not send it to the President of India with all concern.

He said, if required the All Political Party on ILPS would have to be consulted again and talks will also be held with the JCILPS.

He further expressed his profound grievances on the death of a student yesterday and said if any police excesses are found, due action will be taken against the personnel involved.

IMPHAL, July 9: Police killing an agitator while a State Assembly or the Parliament is in session is very rare, observed veteran politician Okram Joy referring to yesterday`™s death of a student in police firing.

He said the Assembly or the Parliament is in session to discuss issues of the people of the land.

Now, who is to be held responsible for the killing of the student when the State Assembly is underway, he asked.

He continued why the State Assembly had failed to discussed the ILPS issue before yesterday`™s incident and why the government failed to give a suo-moto statement on the issue till date.

The State government has given its statement only after the death of the student, Joy said.

The government has been neglecting the people`™s agitation which hurt the public sentiment, he continued.

Now this resulted in a mass public agitation leading to the death of the student, he said.

If the government had given a suo-moto statement on the issue earlier or atleast one of the MLAs raised the issue during the Assembly session, the Robinhood would have been still living, Joy continued.

Yesterday there were many businesses during the Assembly session, various issues were discussed, but not a single discussion on ILPS, which is unfortunate, he declared.

He further strongly condemned the incident of police action resulting in the death of the student and injuring more than 40 students.

The day will remain etched in the history of the land, he observed.

It is also very unfortunate that even the district magistrates had allowed police personnel to fire tear gas shells, rubber bullets, mock bombs, water cannon and lathi-charge against the students, he continued.

It is also really shocking that the police personnel had shot the tear gas shell directly to the students who were taking out the rally, he lamented.

The ex-MLA also said that the police should be aware that any firing be it tear gas shell or rubber bullets should be fired at a 33 degree above the public.

There is still no report of at what angle the tear gas shell hit Robinhood, but it clear from primary investigation of medical report that he was killed by a tear gas shell, he continued.

O Joy also observed that the incident occurred due to the arrogant nature of the police who behave like beast against the public.

The personnel involved should be given befitting punishment according to the land of the law, he said.

He further blamed the Manipur Regulation of Visitors, Tenants and Migrant Workers Bill, 2015 for all these violence.

Manipur ILP Demand intensified: An injured protester carried away by Police

IMPHAL, July 10: For the second consecutive day, protestors continue to take out rallies, block roads and confront the police in different parts of the State capital amid a curfew.

The agitation demanding the withdrawal of the Manipur Regulation of Visitors, Tenants and Migrant Workers Bill and implementation of a proper Bill which could safeguard the indigenous people of the State took a serious turn in the aftermath of the death of a student of the Ananda Singh Higher Secondary School on June 8 in police action during a protest rally.

For the second day today, protestors defied the curfew and came out to the streets.

A huge number of Khetrigao constituency residents tried to storm MLA Amin Shah`™s residence around 1pm but were stopped by the police.

The protestors wanted to talk to the MLA on the present ILPS issue.

It is also learnt that Nambol residents had also tried to storm the residence of local MLA Nameirakpam Loken but the police thwarted the attempt around 3pm.

However, protestors continue to burn tyres, place tree branches, rock boulders and iron posts on the roads. Sit in protests were also staged in different parts of the State including at Kongba crossing, Khongman Mangjil, Singjamei Bheigyabati leikai.

At Lairikyengbam Leikai, the JAC formed in connection to the death of Sapam Robinhood organised a mass rally.

The rally started from Lairikyengbam Leikai and continued till Lamlongthong where it was met by a strong police team.

Soon a tussle ensued between the protestors and the police. In the tussle, the angered protestors threw the police barricade into the Imphal River. They also shouted demands to safeguard the indigenous people, save Manipur, save North East people.

The protestors also shouted at the police that the demand was also for the police and their families and `Take our lives, but don`™t destroy our Home, please, we are eager to sacrifice for the ILPS.`

After the brief tussle, they returned back and took the rally upto Popular High School and return back.

During their return they tried to march towards the State Assembly building where the last day of the 11th session of the 10th Manipur Legislative Assembly was underway.

They were again stopped by security personnel along the Dingku Road.

During the process, an IRB personnel fired from his service rifle resulting in the protestors turning violent and throwing stones at the police personnel who also fired back rubber bullets, tear gas shells and lobbed mock bombs.

IMPHAL July 8: All the repairing and renovation works of Primary Health Centres under Family Welfare Department for the year 2014-15 were executed by the department itself without assigning the works to any work related department or agency.

20 such programmes were supposedly carried out ranging from Rs 5 lakhs to Rs 9,99,891 in six districts namely Imphal East, Imphal West, Churachandpur, Bishnupur, Senapati and Chandel, he said.

Regarding to a question raised by MLA Samuel Risom regarding Winson Kamodang, the former headman of Ramphoi (Nambisha) Village who is presently in a Myanmar jail, the Home Minister said that he is presently in a Myanmar jail.

He further informed the house that the State Government has already moved the central Government/ MHA to take the matter with Ministry of External Affairs at the diplomatic level for repatriation of Winson Kamodang to his country.

By Oken Jeet Sandham

When the NSCN (K) unilaterally abrogated ceasefire with the government of India in March this year, nobody took it very seriously. Many in Indian side were wondering when the outfit had entered into ceasefire with the Myanmar government, while many intelligentsias felt that such truce with Myanmar government indirectly undermined Delhi`™s truce with the outfit. Such attitudes coming from India side have also actually undermined the capability and integrity of the Myanmar government.

We should know that there are many insurgent organizations fighting against the Myanmar juntas for decades. The country had the notoriety of being run by the Military for decades and their administration was so fragile that it became one of the most backward and underdeveloped countries in the world. And somewhat a ray of hope started coming in when the democracy started taking over the Military government. It is a matter of shame on the part of Indian government that it being the largest democratic nation in the world terribly failed to help restore democracy in Myanmar. The Western countries played important roles in restoring democracy in Myanmar. It was remarkable that as soon as the civilian government took over the Military government, the President of the United States of America Barack Obama visited Myanmar and met Myanmar President Thein Sein and Myanmar democracy icon Aung San Suu Kyi. It was heartening to see the joint press conference of Obama and Kyi held at her house in Yangon, Burma. Obama`™s visit had literally sent a very positive message across the world and greatly motivated the hard lined Myanmar Military leaders that their (Myanmar military juntas) job was different.

On the contrary, the past Indian Primes Ministers had not tried to visit Myanmar. Prime Minister Narendra Modi visited Bhutan as soon as he became Prime Minister and not Myanmar. Top brass of Indian Army would visit Myanmar mostly to discuss about the northeast insurgents. New Delhi fails to realize that democratic Myanmar is better than Military Myanmar.

Ethnic minorities make up about a third of Myanmar`s population of roughly 50 million. They mostly live in the seven states and divisions named after the Shan, Kayah, Karen, Mon, Chin, Kachin, and Rakhine ethnic groups. Now look at the fast democratic development in Myanmar and the series of positive developments taking place with various insurgent groups operating in the country. It is not only NSCN (K) that has large presence there but there are also dozens of ethnic minority insurgent groups fighting for greater autonomy or independence from the dominant ethnic Burman majority. Myanmar military have been fighting with them for decades with no solutions in sight. It is only after democratic government coming in that series of ceasefires have been declared with many of these groups. It is nothing wrong when the NSCN (K) entered into ceasefire with the Myanmar government as they have their large presence in the country, besides the outfit`™s chief, SS Khaplang himself is a Myanmarese Naga. In fact, it is a blessing in disguise as such ceasefire with Myanmar government will immensely lighten the burden on Delhi. It is generally believed that the Naga issue may defy solution without the cooperation of the Myanmar government.

Soon after the unilateral abrogation of ceasefire with the Government of India, the NSCN (K) started attacking on the Indian security forces particularly Assam Rifles in Nagaland and Arunachal Pradesh. However, Delhi still shrugged it off as none existent without even reacting to it. However, the BJP-led NDA government`™s blue-eyed boy, Kiren Rijiju started using highly unfavorable and provocative languages. He, however, denied making such statement after about one month.

Interestingly, the Center and its army did not realize of NSCN (K) and its fraternal ties with many insurgent groups in the northeast till such time when Indian army was badly attacked on June 4 last month in Manipur`™s Chandel district bordering Myanmar. 18 soldiers were killed while scores were injured in the deadly attack. The incident drew worldwide attention and neighboring countries, Myanmar, Pakistan and China, sharply reacted to the subsequent statements of Indian authorities.

But in Nagaland, the situation is different which Delhi fails to realize. For Delhi, Indian army will be the answer in such a situation like the one happened in Manipur on June 4 last. The Nagas cannot afford allowing saber-rattling between the Indian army and any Naga underground groups, because they had suffered enough and experienced all sorts of tragedies due to unresolved political conflicts over half-a-century.

The TR Zeliang opposition-less government in Nagaland has hurriedly constituted the Nagaland Legislature Forum (NLF) with the objective of apprising the Central leaders to expedite the peace process with the Naga underground leaders for an early solution to the Naga issue. They are also urging the Government of India not to abrogate the ceasefire with the NSCN (K), while resolving to request the Naga Hoho and Eastern Nagaland Public Organization (ENPO) to send a delegation to meet NSCN (K) Chairman SS Khaplang for resumption of ceasefire with the Government of India as it is also the desire of the state government as well as the people of Nagaland.

During Neiphiu Rio`™s regime in Nagaland, the Joint Legislature Forum of Nagaland (JLF) was formed. It was momentous in the history of the Naga Political issue when the entire 60 legislators under the banner of the JLF could boldly display a show of unprecedented unison to the Central leaders for the cause of the settlement of the Naga political issue. But sadly, they lacked the courage to influencing the Government of India and the NSCN (IM) to make their `Agenda` public. Today, the process is 18 years old. But much to the chagrin, none of the party—be it his (Rio) Government or Delhi or NSCN (IM) — could make the status of the process public.

It is still very complicated as to how NSCN (K) chief will be convinced for resumption of ceasefire with Delhi while the latter is not showing any sign for immediate resumption of ceasefire with the former. Looking at the fast emerging trend in the aftermath of the NSCN (K)`™s unilateral abrogation of ceasefire and their subsequent attacks on Indian security forces, the Naga peace process appears to be more complex and grim.

Northeast people do have historical relationship with Myanmar people, besides many villages of Nagas and Manipuris are in Myanmar. It is reported that there are six Naga MPs in Myanmar while two Naga MPs in Indian side. The Myanmar army`™s going against NSCN (K) in Myanmar has slim chance as these six Naga MPs will uproar. Delhi needs diplomatic channels with its counterpart in Myanmar instead of asking them to flush out NSCN (K) or any other northeastern insurgent groups from their soil.

IMPHAL, July 8: Amidst a Assembly session boycott imposed by the JCILPS in demand of withdrawal of the The Regulation of Visitor, Tenant and Migrant Bill 2015, women leaders of several women based organisations of the State including the women wing of the JCILPS stormed the Keishampat Keisham Leikai residence of Speaker Th Lokeshor this morning.

The women leaders wanted to meet the Speaker in person before he leaves for the ongoing Assembly session but were told that the Speaker had already left.

Soon a police team led by additional SP (Law and Order) S Ibomcha arrived at the scene and spoke with the women leaders.

After the leaders remained adamant on meeting the Speaker, five of them were allowed to wait inside the Speaker`™s residential compound, while the others remained gathered at the Keishampat Lairembi Community Hall.

Speaking to media persons, Pourei Leimarol Apunba Meira Paibi Lup, president Memchoubi said that the Assembly Bill passed by the government is not to protect the people of the State but it encourages influx of outsiders.

We are really disheartened and dissatisfied with decision taken by the government and we are here at the residence of the Speaker so that we could let him understand the importance of the ILPS demand and the need to bring it up for discussion during the Assembly session, she continued.

Why is it that the government continues to remain mute spectators to the public outcry even after a series of agitations have been staged, she said.

Since the government seems to be not at all concern with the welfare of the people, we have decided to boycott the next election.

MPSC`s Latest RTI reply hints at massive irregularity in 2010 MCS exam

Respected Sir, Most of the examinations conducted by the MPSC do not happily get finished without a controversy. Be it for a right reason or wrong reason. We do find

Respected Sir,

Most of the examinations conducted by the MPSC do not happily get finished without a controversy. Be it for a right reason or wrong reason. We do find instances where many candidates who felt Set down use to take legal recourse for redressal of their grievances. I am also one of such candidates who have fought retentfessly to get to the bottom of the alleged violation of the MCSCC Examination Rules in the conduct of 2010 MCS/MPS exam. My whole fight actually began when I was informed by the MPSC vide RTI reply dated 05-11-2012 that I had not obtained the qualifying mark in the General English paper and as such my other seven main papers had not been evaluated by virtue of the provision incorporated under Note (ii) of Section II of Chapter It of the aforesaid Rules. Surprisingly, it was later found that all my seven main papers had been duly evaluated by the concerned examiners which virtually put me in the fourth position of the overall written test of the said exam. Leaving aside all these for a while, what concerns us the most at the moment is how MPSC had applied the same provisions of Note (ii) in 2010 exam and subsequently in 2013 & 2014 exams. To get a complete picture of 2010 exam, we need to move a little back to the court proceeding. During the writ proceedings, MPSC by filing an affidavit had submitted that that the provision under Note (ii) is only a directory rule, but not a mandatory rule that until and unless the qualifying paper (General English Paper) is examined and the result thereof is out, the other papers cannot be examined. MPSC further submitted that there is no such legal necessity that the General English paper should be examined first and therefore, under compelling circumstances, all the papers of the candidates including General English paper were examined at the same time (simultaneously) to save time, money and everything. Thus the initial statement made by the MPSC in their RTI reply which indicated non-evaluation of my seven papers on account of my failure to obtain the qualifying mark in General English paper and the later statement made by the MPSC in their affidavit regarding simultaneous evaluation of all the papers including General English paper are contradictory to one another. Even though the Hon`ble High Court of Manipur has also decided the case in my favour, the controversy surrounding 2010 exam does not seem to end even today. The recent development has further put a serious question mark on the credibility of those officers of the MPSC who were at the helm of affairs during 2010 exam, I had filed another RTI application on 01-10-2014 but this time with respect to 2013 and 2014 examinations. The information which I sought were how many candidates have failed to qualify in the General English paper in 2013 and 2014 exams and whether the remaining seven main papers of those candidates who had failed to qualify in the Genera! English paper have been evaluated further or not. Despite my repeated request, MPSC refused to furnish the information. Then I had filed a complaint petition before the Central information Commission (CIC). On the direction of the CIC, Manipur Information Commission took up the matter and summoned some officials of the MPSC. Consequent to that, the information has been finally provided by the MPSC after almost eight months vide RTI reply dated 12-06-2015 which reveals that only 7 candidates in 2013 Exam and 14 candidates in 2014 Exam had not qualified in the General English paper and the other seven main papers of the said candidates had not been evaluated, (in 2010 exam, 109 candidates were deliberately disqualified in General English paper). Therefore, the subsequent action of the MPSC clearly implies that 2013 and 2014 exams had been conducted with maximum care keeping in mind the legal requirement as envisaged under Note (ii) of the examination Rules. The word `directory` as cleverly invented by the MPSC in order to sweep the irregularities of 2010 exam under the carpet had ultimately become a `mandatory` one in the subsequent examinations.Summing up, the latest RTI reply which has vividly reflected MPSC`s strict adherence to the examination Rules in 2013 and 2014 exams regarding evaluation of seven main papers of only those candidates who had qualified in General English paper almost confirms that MPSC had altogether violated the provisions of note (ii) in 2010 exam. This again leads to the logical conclusion that the MPSC had also made a conscious attempt to interfere with the due judicial process by misinterpreting the provision of note (ii) as a “directory” rule. Lastly, MPSC may win or lose court cases but somebody has to be necessarily there to take cognizance of serious acts of impropriety or immorality committed by any of its officials. Always switching to the idea of fighting every case in a court of law by hook or by crook is not a healthy proposition for a constitutional authority like MPSC. Legal expense is not a big deal for MPSC so long as they are getting adequate fund from the State government. But for an individual litigant, it is an uphill task to fight a case financially.Transparency and accountability is what everybody expects from MPSC but not `manipulation` `discrimination1 and `litigation`. The deadly combination of this trio can ruin the entire lives of many deserving candidates.

Yours Faithfully
