AFSPA as India’s Democracy Test

The extremely haughty manner in which the NDA government dismissed the finding of the Justice Hegde Commission which was mandated by the Supreme Court of India to look into the very serious allegations of fake encounters in Manipur is to say the least, alarming. It seems to confirm the widely held apprehension that under the new government headed by Prime Minister Narendra Modi, there is a real danger of the executive assuming too much asymmetrical power for itself, even those which should rightly belong to the judiciary and legislature. It may be recalled the Justice Santosh Hegde Commission had come out with the startling report that of the random cases of alleged fake encounters he picked up for examination during his enquiry, he discovered to his consternation all of the allegations had convincing evidences. To this the Centre simply said the procedures adopted by the Justice Hegde Commission for the enquiry was flawed. It also virtually said there had been no fake encounters in Manipur, and had there been even one, the responsible security personnel would not have gone unpunished, saying, as quoted in a report by The Times of India which appeared on August 17, that “the Union government shall not tolerate even one false encounter and shall not spare anyone guilty of false encounter, but at the same time, it is necessary to ensure that no innocent security personnel is harassed for an official act performed in good faith and without any mala fide intention.” It may be recalled, the Santosh Hegde Commission was appointed on the direction of the apex court following a public interest litigation, PIL, filed by two NGOs, namely ‘Extra-Judicial Execution Victims Families Association of Manipur’ and ‘Human Rights Alert’ which alleged there had been at least 1,528 extra-judicial killings in the course of the last 30 years in Manipur.

The matter is alarming because the Centre’s reply was not in any way about providing counter evidences to prove the allegations wrong, employing prescribed procedures of democratic adjudication, but was more akin to simply issuing an official fiat which audaciously called a judicial commission flawed and its findings untenable. In other words, it is placing its own knowledge and understanding of a given grave criminal situation, arrived at from reports of its own executive functionaries, above those of a judicial commission. This is despite the fact that the writers of these executive reports are often the accused in the cases under scrutiny. How can an accused be made the judge of the case if justice deliverance is the objective of the entire exercise? A lot many intellectuals in the past had argued with optimism that India’s democracy has too many safeguards for any single party, much less individual, to endanger. Among these safeguards that they cited were the independent institutions of democracy, such as the judiciary and free media, and therefore this surprising trifling of a judicial probe’s findings must strike as disturbing to any believer in democratic India.

This is not to say all judicial probes must be held as sacrosanct. Behind the judiciary too are humans and as humans they are equally prone to mistakes, weaknesses, biases, incompetence, prejudices as anybody else, including not the least the men behind the executive. The opinions and verdicts of the judiciary too can be, and must be, challenged whenever they are seen not to be in the cause of ultimate justice, but there are accepted ways of making these challenges. Simply dismissing a judicial commission’s report as unacceptable must therefore be seen as an aggression on democracy itself. The Union government, or for that matter the State governments, are perfectly within their rights to defend any law they make, not just the Armed Forces Special Powers Act, AFSPA. The Centre does precisely this on this instance, justifying the AFSPA as an extraordinary means to counter an extraordinary situation. Some of the arguments may even be hard to refute. But the reminder we want to flag here is that in this defence, it cannot also be its own judge. Such a collapsing of powers into a single hand happens only in a dictatorship, and when this happens, all believers in the virtues of democracy have a right to ask if they are not being led into a dictatorship. The executive wields the guns of the State, but the sublime beauty of a democracy is that the power that flows out of the barrels of the State’s guns, is not in the sole control of the direct wielder of the guns, but jointly held as shared responsibility of the various pillars of democracy. This beauty is what is being shaken by the Centre’s unceremonious rebuff of the Judicial commission’s report.

It would however be unfair to level this allegation of the executive demolishing the other pillars of democracy to the NDA government alone. The UPA government under Prime Minister, Manmohan Singh was in many ways only marginally better. The Justice Jeevan Reddy Commission which recommended radical changes to the AFSPA, in particular making the AFSPA accountable to civil law by abolishing it and incorporating much of its provisions to the Unlawful Activities Prevention Act, UAPA, is just one prominent example. Although nothing was overtly stated to humiliate the commission and its findings, the UPA government too simply chose to kill it by ignoring and deliberately forgetting its existence altogether. Historically speaking, though it is too early to say anything for certain, we may not be altogether wrong to hazard the guess that the biggest challenge to Indian democracy may ultimately turn out to be how the nation and its rulers handle the AFSPA issue.

Sharmila released, resumes hunger strike

IMPHAL, August 20: After having being detained in the judicial custody for over 13 years for allegedly attempting to commit suicide, Anti-Armed Forces Special Powers Act (AFSPA) activist, Irom Chanu

IMPHAL, August 20: After having being detained in the judicial custody for over 13 years for allegedly attempting to commit suicide, Anti-Armed Forces Special Powers Act (AFSPA) activist, Irom Chanu Sharmila on Wednesday was released from JN Hospital security ward, for the first time, free from any charges earlier lodged against her.

Sharmila was released around 6.14 pm. She was freed, following a judgement by the Session Court, which ruled that there was not enough evidences to prove that she was attempting to commit suicide and observed that Sharmila’s demand is a political demand through lawful means for repealing a valid Act.

Soon after stepping out from the security ward, Sharmila’s first word to the media was “I need mass support from my people”, her eyes swelling with tears, indicating she is not just about to give up her protest.

After the brief interaction with the media persons within the JNIMS campus she along with the trustees of the Just Peace Foundation and representatives of Sharmila Kanba Lup (SAKAL) headed straight for the SAKAL temporary camp near the JNIMS hospital and resumed with her protest.

“I feel very happy in winning this case as it proves that I am right, what I am doing is for the sake of justice. In return what I want from my people is mass support rather than songs singing my glory. That is what I need at the moment”, continued Sharmila.

Further responding to queries raised by media persons whether she ever expected to be set free, Sharmila said she loves freedom as much as others but what she desire was freedom with success.

When asked about her expectations from the present NDA Government and its leader Narendra Modi, Sharmila observed that India being a democratic country, the Government will concede to the demand of the people if a unified voice against AFSPA is raised adding that “Government is for the people, of the people, by the people”.

While hailing the Manipur Session Court judgement of cancelling her detention under section 309 alleging her of attempting to commit suicide, Human Rights Activist who is also a trustee of the Just Peace Foundation, Loitongbam Babloo said that since the judgement of the concerned court has validated Sharmila’s demand as political demand, the time has come to carefully and judicially consider Sharmila’s act, instead of criminalising it.

Further revealing that Sharmila has personally wrote to the Prime Minister of India and acknowledgement for the same has been received, Babloo divulged that the focus will now be shifted to the Centre.

Meanwhile, justifying on Government move of arresting Sharmila and subsequent detention under Judicial custody, deputy Chief Minister Gaikhangam clarified that his Government has no personal enmity with Sharmila or her protest. However, he maintained that the Government was only concerned with Sharmila’s health.

CSCHR lauds Sharmila’s release verdict

IMPHAL, August 20: The Civil Society Coalition on Human Rights in Manipur and the UN (CSCHR), a coalition of twenty-four (24) indigenous peoples’ human rights organisations of Manipur has welcomed

IMPHAL, August 20: The Civil Society Coalition on Human Rights in Manipur and the UN (CSCHR), a coalition of twenty-four (24) indigenous peoples’ human rights organisations of Manipur has welcomed the historic and far-sighted judgement and order for the immediate release of Irom Chanu Sharmila as victory of her and the people of Manipur’s moral and political stance.

A statement of the coalition said it would like to stress that the Armed Forces (Special Powers) Act, 1958 facilitated extensive militarisation in all indigenous peoples land and territories of Manipur.

The government of India refused to repeal the Act inspite of the recommendations of series of UN human rights bodies, including the UN Special Rapporteur on Violence against Women, Rashida Manjoo during her visit to Manipur in 2013.

It said the coalition denounces the serious human rights violations, in particular torture and extrajudicial executions, perpetrated both by the Manipur Police along with the Indian Army under several emergency legislations, including the Armed Forces (Special Powers Act), 1958 all over the State of Manipur.

The justice (retd.) Santosh Hedge headed high-level commission appointed by the Supreme Court of India had already confirmed the fake encounter killings perpetrated both by the Manipur Police and the Indian Army and paramilitary units operating in Manipur, it said while adding that the State government usually resorts to violent repressive measures, including prolonged invocation of Section 144 prohibiting conglomeration of five or more people under Code of Criminal Procedure, arbitrary detention and torture of human rights defenders throughout the State, and in particular within the valley districts.

The CSCHR fully endorses the appeal of the Naga People’s Movement for Human Rights (NPMHR) and Asian Indigenous Peoples’ Pact (AIPP) for the immediate withdrawal of CrPC Section 144 that has been invoked in and around Ukhrul in Manipur for more than a month, and to end all forms of militarization and martial law governance, it said.

The Coalition would like to urge upon the Government of Manipur to immediately withdraw the invocation of sections of CrPC in Ukhrul Town in the last month and the imposition of the similar restrictions in Imphal East and West districts since the last more than one decade, and to end all forms of militarisation in all indigenous peoples territories of Manipur under the Armed Forces (Special Powers) Act, 1958 and to repeal the Armed Forces (Special Powers) Act, 1958 and other emergency laws and policies in Manipur, it said.

Attempts to politicise ILP is unfortunate: Gaikhangam

IMPHAL, August 20: Deputy Chief Minister Gaikhangam has stated that the all political parties committee formed to address the vexed issue of ILP implementation in the State is trying hard

IMPHAL, August 20: Deputy Chief Minister Gaikhangam has stated that the all political parties committee formed to address the vexed issue of ILP implementation in the State is trying hard to find a solution with the help of legal experts and prominent intellectuals from Manipur University.

He was replying to media persons about the progress made by the all political parties committee on the ILP issue during the occasion of the birth anniversary of late Indian Prime Minister Rajiv Gandhi at Congress Bhawan in BT Road today.

Stressing that the committee is committed to finding a timely solution on the ILP issue, the deputy CM said that it was unfortunate that some individuals with vested interests were questioning the commitment of the committee to politicise the issue.

The ILP issue is sensitive and complicated and we have requested some legal experts, intellectuals in Manipur University and a retired justice for their suggestions on the ILP issue, he said.

Gaikhangam said we are waiting for their response but that doesn’t mean that the government is trying to delay the issue or divert attention from it.

We are not yet quite sure whether the State government can enact a law to implement ILP on its own or if it is purely within the purview of the Central government, he said adding that the State government is also not sure about the methodologies or approach to be adopted while mounting pressure on the Central government.

The deputy CM said we have to examine the various aspects of ILP before taking a hasty decision.

Commenting on the court’s ruling on Tuesday for the release of Irom Sharmila who has been on a fast for many years demanding the repeal of the draconian Armed Forces Special power Act, 1958 from Manipur and entire North-east, he said the judgment of the court has not been received till today and it has to be examined carefully what is exactly contained in the judgement.

The deputy CM said he has not been briefed about the matter by his officers and added that the government is concerned about Sharmila’s life as her life is precious to all the people of Manipur.

He also said that he attended a formal discussion of the Congress party as part of a routine consultation of the AICC but could not meet Sonia Gandhi during his visit.

IMPHAL August 20: Seven students bodies have opposed the bandh imposed by Emboi Serto led All Tribal Students’ Union of Manipur and its proposed indefinite economic blockade by calling the timing of its imposition as ‘inappropriate’ because the government has asked for some time to act on the demands of the tribal students over the issue of implementation of Central Educational Institution Act, 2012 in Manipur University on Wednesday.

The Churachandpur District Students’ Union (CDSU), Thadou Students’ Association (TSA-GHQ), Anal Student Chandel, Maring Student Chandel, Aimol Student Chandel, Tangkhul Katamnou Saklong (TKS) Ukhrul and Zaliagrong Students’ Union Manipur (ZSUM) Tamenglong have stated that they will not support the bandh imposed by Emboi Serto led ATSUM and the proposed indefinite economic blockade.

The seven student bodies said that the 24 hours bandh will only affect the lives of hills people. Meanwhile, the government has asked for some time to consider the demands of the tribal students’ bodies over the implementation of Central Educational Institution (Reservation in Admission) Amendment Act, 2012 in the Manipur University.

The students’ bodies have stated that it would be a wise decision for the Emboi Serto led ATSUM to call off any form of agitations as the government needs room to reconsider.

Zelaingrong bodies question claim of settling Maram assault case

IMPHAL, August 20: Several Zeliangrong bodies have submitted a representation to the director general of police, Manipur declaring the claims of the Zeliangrong Union and the Maram Naga Union settling the Maram assault incident in accordance to cu1stomary law as “abetment of crime.”

Referring to the assault of Ringsanbou Newmai a student of the Don Bosco Maram on July 28, the Zeliangrong Youth Front, All Zeliangrong Students’ Union and the Zeliangrong Union Manipur in a joint statement have said there is no such law in customary, national laws or international laws that such crime should be settled by offering a pig measuring five fist or over exchange of rice plate.

It questioned the basis for their claims especially when the victim is struggling for life and undergoing medical treatment in the ICU of JNIMS hospital?

There ZU and MNU have no authority to discuss this particular matter without the participation, involvement, consent or knowledge of the victim family as such it is total contradictory to customary or any law, it said.

Further according to the statement, the victim family has already declared their stand and position very clear of which was widely publicised in various newspapers that any settlement without delivering justice to the victim shall not be accepted.

It said the ZU and MNU announcing their claimed of settlement on the highly condemned crime shows the conspiracy of ZU and MNU in the crime and accused them of being hand in glove with the accused.

It has further urged the police to take action in the case which has been registered under FIR u/s 326/34 IPC against the accused Hingba Mathew, warden, Josephine Girls Hostel, Maram.

The State Home Minister claimed of “people friendly police” force has now turned into “criminal friendly police” force, if the accused of the murder attempt can be let scot free then the State govt, it said.

Manipuri Directorate celebrates its first anniversary

IMPHAL, August 20: The Language Planning and Implementation Department has taken a firm stand of not following anyone in the matter of the Manipuri language and it’s free to do anything about the development of the language, stated director of the department Dr Laishram Mahabir Singh.

He was speaking on the joint celebrations of the first anniversary of the Directorate of Language Planning and Implementation and the 18th anniversary of the inclusion of Manipuri Languages in the Eight scheduled today at the premises of Directorate of Language Planning and Implementation.

He said that the staffs have suffered for around 20 years to make it a full-fledged department and they are quite a skilled lot to develop the language.

However, the Manipuri language is likely to be divided due to differences between people following the ancient Meitei faith and Hindu religion because the Manipuri language has been mixed with Sanskrit and our own language, he said.

He appealed the people of the State to support in their movement for the development of Manipuri language.

Manipur Science and Technology director Uttam Chand Laishram stated that the Manipur Institute of Technology (MIT) in collaboration with the Manipur Science and Technology will make e- language translations from Bangali to Meitei Mayek to English within two months.

Continuing that with the collaboration of Manipur Science and Technology and National Electronic IT (NELIT) it will also be producing an e- dictionary from English to Manipuri, he said they plan to build software for phones to access the application easily.

Eminent Manipuri Scholar RK Jhaljit Singh expressed his happiness on Language Planning and Implementation department becoming a full-fledged department and has wished for the welfare and development of Manipuri language while also appealing to work hard for raising it to status of a classical language.

There is a need to plan properly for the development of Manipuri language because development a language is hard, he said adding that the Manipuri language has its own script but the language has been mixed up with other languages. Meanwhile, the All Manipuri Students Union (AMSU) also observed the 22rd Manipuri Language Day at its premises.
