IMPHAL, Jan 31: Beginning from 2008 till 2011, the state has witnessed 246 cases of child trafficking,many cases are seemingly still unreported and may be just the tip of the iceberg.

The fact was stated by K Pradip Singh,member secretary of Child Welfare Committee , Bishnupur at a one day orientation program on Human Trafficking held at Lake View Hotel at Moirang. The program was organized by the Social Welfare Department and participated by youths from Bishnupur and Churachandpur district yesterday.

Pradip further spoke on the definition, dynamics and magnitude of human trafficking in Manipur.He stated that three are mainly three types of trafficking, viz. Drugs trafficking , which is the most lucrative trade and followed by Arms trafficking and next is the issue of human trafficking.At present , the trade in human trafficking has surpassed the arms trafficking and has become more widespread. Six to eight lacs individuals are trafficking in a year among international and national borders and largely involves women and children, he said.

Further,the objective of the traffickers is to offer lucrative jobs abroad and in other states, mainly free education, free shelter, placements in beauty parlors, spas etc. The trafficker may pose as a samaritan and try to gain the trust of the family and the individual and may even give the offers through the media.

Mentioning instances of children and women from Manipur being trafficked, he said that at least nearly a hundred children were rescued from other states like Karnataka, Tamil Nadu, Delhi etc .Some teenage girls were rescued from entering the sex trade by force, he mentioned.

Pradip  stated that  the family members and individuals should discern the possibilities of getting a good future for their wards and self, else there is every possibility of becoming a victim of human trafficking. Blaming the ineffectiveness of the education sector of the state and lack of unemployment as the main causes of falling prey to trafficking, he said that the state government should initiate steps to curb trafficking.The program was attended by Bishnupur Child Welfare Committee chairperson, L Pishak Singh and Ch Tampakleima,district protection officer, ICDS, Bishnupur.

Speculations of any possible outcomes of the just concluded elections to the 10th Manipur Legislative Assembly are prohibited by the Election Commission of India, ECI, in order to ensure voters in states where the elections are being held later are not swayed by what they see as a trend. Broad pictures of what may be the likely scenario after the results are declared should however do no harm in this regards provided these pictures do not speculate on which party is generally favourably inclined to the dominant public mood. We are interested in sketching such a party-neutral picture, not so much to anticipate which party is likely to come to power, but as a caution of what troubles may lay ahead. The election office in the state is in a rather upbeat mood, considering the polls went off with much less violence than initially anticipated. In the valley districts, because of unprecedented security measures, the polling day was peaceful except for some minor skirmishes. In the hill districts, because of the much larger area spread (nearly ten times the valley), security understandably could not have been as tight, and therefore the reports of disruptions of the election process at many places. As the latest information from the election office goes, there will be repoll in 34 polling stations in the five hill districts on February 4. This time, the security personnel engaged in election duty in the valley districts being now free, they should all be available for providing much tighter security to the 34 stations. Hopefully all will go well, and voters will be allowed to exercise their free will in selecting their leaders.

But election trouble can hardly be said to be over. The Congress which went to the elections as the ruling party was the only one to field candidates in all the 60 seats of the Assembly in the state. According to the chief minister, Okram Ibobi, whose comments appeared repeatedly in the media in the run up to the election, the party would return at least 35 MLAs. The only other party to somewhat rival this optimism is the new entrant, Trinamool Congress, which fielded 47 candidates making it the party with the second largest number of candidates in the fray. The CPI which was a ruling ally has put up 24 candidates and this is the third largest number. The three are also not in any pre-poll alliance. The rest of the parties are way behind in terms of number of candidates fielded. But they have managed to reach some degree of pre-poll partnerships. As to whether these alliances will be able to hold once the election results are known is another story. The larger of the alliances, is the Peoples’ Democratic Front, but even together their number of fielded candidates total only 45. The other alliance is between the BJP and the MPP, and they too together tally only 33. The MPP, once a formidable pole in any electoral equation in the state, having emerged from the popular agitation for full statehood for Manipur in the 1970s, is today only a shadow of its former self, thanks to unimaginative leadership and greedy, disloyal political turncoats in its ranks.

Under normal circumstances there would have been no cause for extra concern, but as we all know, the Congress is being opposed openly by a united committee of a number of militants groups, CorCom, in the valley, and also in an undeclared but nonetheless with bare fangs in the hills by another underground group. This being the case, if any single party, in this case the ruling Congress, is able to come out with a clear majority, the issue would not be too complicated. However, if the Congress miss the magic number of 31 to become a single party majority, it is unlikely the CorCom would not step in to ensure no other smaller parties lend support to the Congress. They would also likely nudge the smaller parties to form a post-poll alliance and come to power. That is, if the Congress fails to reach the absolute majority figure even if by a small margin, they would not have it easy to muster the required number. But, as the pre-poll partnerships are indicating, there are some parties which are going it alone. The case of the CPI is interesting, as they were an ally of the Congress in the last government, and since they cannot hope to come out with a majority on their own ever, perhaps they are already anticipating a piggy back ride on the Congress and be a strange bedfellow of convenience yet again. Whatever it is, a hung Assembly will spell much more than the difficulty of forming a government because of the low ceiling on the cabinet size imposed by the Anti Defection Law, thereby the paucity of ministerial chairs to offer and lure potential partners.

On a fateful date of 22 May 1958, Parliament of India passed a draconian law called the Armed Forces Special Powers Act. Sections 4 and 5 of the ordnance give sweeping powers to the Officers, Warrant Officers and Non Commissioned Officers of Indian Army and Indian Air Force. Simply stated; these are:-

a) Fire upon any one that you suspect to have instigated disturbance

b) Use required force to arrest the perpetrator of disturbance and take possession of the man. No arrest warrants are required.

c) Death; if caused to the suspected person/persons in the process of apprehending him/them cannot be tried in terms of the proviso of the clause of `men slaughter` of the Indian Penal Code.

d) Neutralise the arms and ammunition Depot from where the persons causing the disturbance are suspected to be supplying arms and ammunitions to create disturbance. No prior permission from civilian authority is required for this.

e) Carry out search operation of premises to find out the suspected fugitives, arms and ammunitions. For this, no search warrant is required

f) Hand over the apprehended persons to the nearest police station with the shortest possible delay. The `shortest` is not defined.

Till 1972, the Governors of the states could declare a particular area or the entire state as disturbed area which could pave way for implementation of the Armed Forces Special Powers Act in J&K, and the North Eastern States. By an amendment, the power to declare an area or a state as disturbed area has been taken over by the Central Government.

This law was enforced in Jammu and Kashmir, whole of Assam and Union Territory of Manipur in 1958. It is still in vogue in the states mentioned.

The manner Manipur King Hijam Irabot was subjugated by VP Menon; an emissary of Government of India in 1949 and the way Manipur was ceded to Indian dominion gave rise to various organisations which gave vent to their feelings with violence. It still continues.

The law was enforced with a lot of vigour in Assam in 1990 to counter the ULFA and other Terrorist Organisations. Currently it has been extended to one more calendar year i.e. up to 24 Dec 2012 in Assam.

I suppose, there was a necessity of the law immediately after independence of the country from the British rule to safeguard the sovereignty and integrity in the western and the eastern parts. After Raja Hari Singh ceded Kashmir to India and when Phizo was firm in his demand of a sovereign Nagaland; Government of India invoked the provision of the act to suffocate the uprising by using Army.

There is a lady named Irom Sharmila of Manipur who is on a fast unto death on this issue. We shall come to that later on. Before that; I would like to dwell upon another draconian law.

The personnel of the three services enjoy a blanket cover as far as the application of legal procedures is concerned. They are covered by another amenity of law; they are subject to concurrent jurisdiction.

The concurrent Jurisdiction enables a soldier to seek justice through the armed forces courts which are known as Court Martial. The offences where a soldier is not subject to concurrent jurisdiction are rape, murder and culpable homicide not amounting to murder.

Section 69 of the Army Act classifies the offences in four categories. These are:-

a) It is not an offence as per the civil law but created for the first time as an offence in Army Parlance

b) Cases which are recognised as offences in both Civil and Army Law

c) It is an offence in civil, but by a legal fiction made to be under Army Law

d) It is an Offence in civil, but same is not included amongst Army Act proviso as an offence either by definition or fictionally

In terms of Act 48 of Army Act 1950, the offences falling under first instance can be tried only by a court martial, the offences in the categories of second and third can both be tried by a criminal court as well a military court and the last instance is tried only by the Civil Criminal Courts.

You may ask; why did I bring out the AFSPA along with Concurrent Jurisdiction?

I have a reason for bringing out the concurrent jurisdiction while dealing with the AFSPA.

Firstly, let us browse through the following:-
a) Let my fraternity; the three services; not take this write up of mine, as umbrage. I have been a member of the armed force for better part of my life. I value the bonhomie, the camaraderie and the sense of belonging. But I am a human being and after hanging my uniform, I live in a society called the Assamese Society. I take it as my duty to dispel the wrong notions about a draconian law called the AFSPA clubbed with the Concurrent Jurisdiction. Lot of people think that they have done sufficiently enough by giving the personnel in uniform the canteen facilities with the added VAT and by hiking the salaries of the soldiers almost at par with the civilian counterparts.  Out of the lot, there are many; particularly those; who matter, forget that there were lives lost while defending the country in the wars that we fought in 1962.1965, 1971; while upholding the sanctity of the Parliament, in the War for Kargil, not to speak of the people who lost their lives as member of the Indian Peacekeeping Force . Lot of people who lost their lives in the Mumbai Carnage along with the civilians were the uniformed people.

b) We do not do anything more than remembering the martyrs on the Vijay Divas. We have already forgotten the departed soldiers of Kargil. `Op Pawan` was not in my wish list. But personnel donning the Olive green, Sky Blue and White were deployed in Jaffna, Mulaitivu and other Sinhalese places. Lot of them perished.

c) Does anybody anytime think of the guys in mufti standing erect on the high ways, in deep jungles and in difficult terrain with a gun under his arm for long periods in the hilly terrains of Jammu and Kashmir and the North East? How long could be the period that these guys are made to keep standing looking at nothing? God knows!  And he also must have a life, a family. He certainly must have his share of problems. He also must have his aspirations and he must also be thinking of some inspirations from somewhere!

d) My heart is with my uniformed friends. But heart alone does not make the complete picture.

While saying that, I would ask you to think of the parade of the ladies wearing nothing in Manipur when one Manorama Devi was gang raped and killed by the soldiers. Think of the cases of missing ULFA cadres after the `Operation All Clear` of Bhutan. Irom Sharmila is only a tip of the ice berg. There would be hundreds of Irom Sharmila if the draconian laws are not amended or repealed. I understand, we require strong laws to protect the hands of the law enforcing agencies, but I suppose, the laws are enacted for the people at large. If the people are not satisfied, what is the meaning of a law?

Let me dwell upon the affected people under the garb of the AFSPA in the North East in Nutshell.

There is a village called Oinam in Manipur. Ask the villagers what the Army did to their girls and women on a fateful evening of 1987. The date and time is just irrelevant now.

There was mayhem and gang rape carried out by the uniformed personnel in Uzan Maidan of Tripura in 1988. This was done when the Governor declared the state as a disturbed area and AFSPA was invoked. The State Government opposed the declaration!

The terror let loose during `Op Rhino` in Assam left scores maimed, killed and incapacitated.

Ukhrul, a town in Manipur was mortared in 1994. Mortars were used again in Mokokchang of Nagaland in December 1994. By the by, mortars are used only against enemy soldiers in a war, not for maintaining law and order!

An Army Jeep unfortunately had a flat tyre. The Jeep had an Army Officer as a passenger.

Why should the Jeep have a flat tyre? The Army opened fire on the civilians in the street of Kohima in 1995 and killed scores.

Thangan Manorama Devi AKA Henthoi was gang raped and killed in Manipur in 2004; when old ladies came out to the street with the placards where `Come Rape Us` was inscribed; they were wearing nothing!

I am afraid to mention Mizoram. I am afraid, because, personnel of Indian Air Force are also a part of the personnel authorised to wield their powers under AFSPA like Army. And they did it with gusto. They threw Napalm Bombs in the villages, they chaffed the civilian population and they bombed the offices to take out the Mizo National Front agitators!

Now, let me dwell on the meat of the story.

The law enforcing agency under the AFSPA is not answerable to anybody for their acts.

There is no provision of an appeal at a court of law against the atrocities committed by the army men.

The cases of atrocities reported in the media are too few. Ask Dr Angela Ao, who was a district Mother and Child Health Officer in Mokokchang during 1994. She would tell you the exact number of women that she attended to! The figures let out in the media were too small against the actual number.

Now I have the following to add:-
a) Power accorded to `shoot to kill` is a clear violation of constitutional right of the  citizen and it contravenes both Indian and International laws

b) It is a violation of `Right to live` under section 21 of the constitution of India

c) It is against the principles of International Covenant on Civil and Political Rights (ICCPR). We are a signatory to this covenant since 1978

Let me come back to my bug bear; the Concurrent Jurisdiction and juxtapose it with the AFSPA.

It seems to me that we are amenable to let loose a team of monsters with constitutional authority to create mayhem at will. We condone their follies with soft hands by bringing them under an umbrella called the concurrent jurisdiction.

I am also privy to a question with all my affected brethren of the North East and the J&K to ask, why we; the peace loving people only have to bear the brunt of the draconian law? Did the Government declare Gujarat as a disturbed area during Gujarat Riots? Was not

Ahmednagar of Maharashtra declared as a disturbed area? What happened during Bombay riots? What happened when LTTE was creating mayhem in the southern peninsula particularly in Tamil Nadu? Did you impose AFSPA in these elite locations?

If not, why in the North Eastern States alone, and why in J&K?

Over all; I feel that, our administration is selective while invoking this law. While doing that, the administration is authorising a section of our own people to choose justice of his choice from his desired courts, at the same time allowing him to carry on with the mayhem under the garb of AFSPA; that too in selected geographical limits. I feel that to be high headed and one sided.

I would like to see an end to the unnecessary debate. I would like to see my brethren in arms in sublime uniforms doing their duties with a smile to protect the motherland. Please stop using the Army to look after internal law and order, please keep them in the barracks and borders, let the borders be in safe hands, and for God`s sake, keep the uniformed people away from the dirty politics.

Ponder; how many Generals do we have from the land of Lachit Borphukan and Chilarai in the country`s Army? We have hardly any. We have hardly any; because; our boys and girls don`t join the Army. Why? Ask yourself. You shall have the answer.

Next to Bangladesh they have the Army on their hate list!

And; I still believe, a job in the three services is just sublime, particularly at the time of need.

I would like to send in a request to all who matter; please review your decisions on AFSPA, it is neither doing justice for the forces nor is it giving you the desired results.

GUWAHATI, Jan 30 (NNN): Murder accused Mahendra Nath Das` writ petition has been dusmissed by the Gauhati High Court on Monday.

After having had languished in prison for the past 12 years Mahendra Nath Das had filed the writ petition last year. The murder accused sought commutation of his death sentence to life imprisonment since he had already spent more than 12 years in jail during the disposal of his plea seeking presidential clemency. The mercy plea was addressed to former President KR Narayanan in 1999 by Mahendra’s family. It was rejected in May last year by President Pratibha Patil.

It it worth noting that Mahendra Nath Das had beheaded one Harakanta Das in the commercial hub of Guwahati on April 24, 1996 and surrendered before the police with the victim`s head. He has been languishing in jail since 1997 after the Sessions Court, Kamrup ordered his execution. The death sentence was subsequently upheld by both the Gauhati High Court and the Supreme Court.

AIZWAL, Jan 30 (NNN): Mizoram Chief Minister Lal Thanhawla today said that due to the long 20-years insurgency, Mizoram could not join with its counterparts in respect of development in economy but with the help of various nationalised agency like NABARD, the state’s economy and development is on the path of improvement.

The chief minister was saying this while delivering a speech at the ‘State Credit Seminar for 2012-13’ organised by National Bank for Agriculture and Rural Development (NABARD), Mizoram regional office in Aizawl today. 

Lal Thanhawla Mizoram is rich in various natural resources which will greatly act as a catalyst in the improvement of the state`s economy. He also informed the gathering that his government will take necessary steps to materialise the points which are mentioned in the State Focus Paper prepared by NABARD.

State Credit Seminar 2012-13 is being organised to discuss State Focus Paper prepared by the NABARD for the upcoming year i,e,. 2012-13.

Lal Thanhawla while expressing concern for improvement of farmers said that agriculture credit flow should be introduced more extensively across the state so that each and every farmer enjoys the benefit. The chief minister also asked NABARD to introduce scheme for government flagship programme New Land Use Policy (NLUP) beneficiaries so as to make them successful in utilising the funds received through the programme (NLUP). He further asked NABARD to continue giving credit support to various self help groups and give special attention to hand-loom sector. “NABARD should frequently organise awareness programme so that loan repayment will be more regular, he appealed. The present condition of loan repayment which stood at 63% is comparatively low,” said the chief minister.

It can be noted that NABARD is expanding its developmental initiatives for all round economic growth of Mizoram through various financial and promotional interventions.

“Trinamool Congress had demanded more security personnel for the hill districts well ahead of the Saturday polls, but it was not implemented by Election Commission of India (ECI) that resulted in a big lapse in security”, Manipur Pradesh Triamool Congress president Kim Gangte alleged talking to the media at the Manipur Press Club here.

The Kuki militant groups, which are under Suspension of Operations (SoO) involving the Central and State Governments, and the NSCN-IM, which is also under peace-talks with the Centre were openly involved and meddled in the just concluded polls. She alleged that the Kuki militants openly supported the Congress candidates, while Naga People’s Front (NPF) was supported by the NSCN-IM.

“Voters in the hill districts failed to get their franchise rights in most of the polling stations and it is quite necessary that re-poll be conducted in the areas where polling process had been paralyzed and manipulated by militants”, Kim demanded.

The Manipur unit Trinamool president also said money and muscle power were used as  tools to woo voters against the model code of conduct issued by ECI. Two Trinamool workers were kidnapped by a Congress supporter in one of the pre-poll incidents, she alleged, adding that a white Bolero jeep bearing no. MNO2-3390 was also used in the kidnapping.

The Kuki militant groups under SoO actively helped the Congress in the polls, Kim further alleged and said that the Saikot polling booth was captured by Congress supporters and no official came up to enquire into the incident.

A formal complaint will be lodged to ECI regarding all the malpractices and fraudulent polling and call for re-poll in almost all the hill Constituencies, she added.

Meanwhile, the BJP today also demanded re-poll in at least eight polling stations in Chief Minister Okram Ibobi bastion 31-Thoubal Constituency on Monday.

In Thoubal Constituency, the presiding officer and the other poll personnel were deputed mostly from Thoubal district and Sugnu and this was a gross violation of the ECI guidelines, BJP national general secretary, Tapir Gao told reporters at Manipur Pradesh BJP office here.

Tapir also said using mobile phones in taking photograph of voter during the polling process was really an absurd policy of the ECI. The party has demanded suspension of the concerned Returning Officer and eight presiding Officers of Thoubal, he added.

In one of the polling stations in the hill, one person sat near the EVM and would press the buttons after asking the voters which candidates they were choosing, the former MP from Arunachal Pradesh alleged.

IMPHAL, Jan 30: Condemning the mishandling of media-persons who were covering the news of Thoubal general strike by supporters of the strike today, AMWJU has announced a total black-out on news related to the strike.

It has further resolved to impose an indefinite boycott of CPI, Manipur State Council and the JAC formed on the death of Moiranghtem Ragini, who was shot at Tentha yesterday, in mysterious circumstances and led to the bandh. 

AMWJU stated that strikers stamped on the spectacles of a journalists after removing it from his face besides firing catapults at the team of media persons.

IMPHAL, Jan 30: The Maoist Communist Party, Manipur has lifted its ban on organizing sumang leela and musical programmes and screening of films outside the cinemas as the elections have ended.

In a press release, the outfit stated that several incidents that occurred during the run up to the polls have justified its decision to temporarily impose the curbs during the prelude despite the attempts from several quarters to wrongly influence the people about its intention.

However, it added that the ban on supporters of four ministers and candidates of Sekmai’s Trinamool Congress and INC will stay.

On the other hand, the MCP alleged that several elements in the Manipur Film Forum has tried to malign its image after misrepresenting its sincere appeals and sway the opinions of the whole organizations dishonestly. 

The decision of the members of forum to air their opinions against the group in a public meeting was unfortunate but the MCP does not hold any grudge against any one of them. Neither has the group served any curb on people involved with Manipuri movies in the past. It had simply requested them not to publicly screen their movies till elections were over and subsequently diluted punishment were meted to three films that went against it.  The group said no monetary demand will be sent to artist or other persons related to the film industry, sumang leela group or singers. The release made an appeal to the film forum to disengage itself from activities disparaging the group and followed it up with a warning that such mistakes will not go unnoticed.

IMPHAL, Jan 30: Two UNLF cadres were arrested during the last 48 hours by security forces.

In a joint operation, a team of 5/9 GR and 6/8 GR of Red Shield Division acting on specific information arrested a UNLF cadre who has been identified as s/s Sanjoi Singh of Project Mapal Taupokpi of Bishenpur district today, stated a press release. He was handed over to Bishenpur police station.

Earlier, personnel of 27 AR arrested another cadre of the same outfit identified asM Devachandra, 23, son of N Mangijao of Laphupat Tera Mayai Leikai from the same locality yesterday.

IMPHAL, Jan 30: The RPF has claimed that at least six army personnel including an officer were either killed or injured in an ambush laid by PLA cadres at an area between Kharao and Narum Khul in Tegnoupal sub-division in the afternoon of January 28. In a press release, the banned outfit stated that its fighters used heavy artilleries and bombs during the attack. However, the wily army has so far successfully kept hidden the real extent of the damage inflicted on them, it added. The outfit stated that the series of attack on security forces by different insurgent groups in the recent past has proven that they are engaged in valiant fight against the enemies.
